Part I - Frozen And Smoked Fish It Is Not Allowed To Submit Offers That Do Not Cover All Items Of A Given Part Of The Order - Such An Offer Will Be Rejected Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Law - As Inconsistent With The Terms Of The Order. The List Of Items In Individual Parts Of The Order Does Not Constitute A Closed Catalogue, And The Ordering Party Reserves The Right To Modify And Update It And May Require The Contractor To Provide Another, Related Food Item, Which Was Not Originally Included In The Tabular List, For A Given Part Of The Order. The Ordering Party Reserves The Right To Reduce The Material And Financial Scope Of A Given Part Of The Order, But Not More Than By 40% Of The Original Gross Value Indicated In The Contractors Offer. The Ordering Party Reserves The Right To Reduce Itself The Possibility Of Increasing The Material And Financial Scope Of A Given Part Of The Order, If It Results From Its Needs And Having Appropriate Financial Capabilities. The Contractors Remuneration Is A Cost Estimate, Determined On The Basis Of The Delivered Deliveries, And The Payment Terms Will Be Specified In The Contract. The Contractor Will Deliver The Subject Of The Order With A Specialized Means Of Transport, Adapted To Transport Food, In Accordance With Applicable Regulations In This Regard, At Its Own Expense, Within The Deadlines, Range And Quantities, In Accordance With The Orders Of The Ordering Party. The Contractor Is Obliged To Proper Security Of Supplies During Transport And Is Fully Responsible For The Delivery And Quality Of The Order. Articles Delivered Under The Order Must Be Of The First Quality, Of The Highest Quality, Approved For Trading In Accordance With Applicable Standards, With Shelf Life Certificates, The Validity Of Which Expires No Earlier Than 7 Days After The Date Of Delivery. Each Offered Article Should Be Appropriately Marked With A Label Containing Such Information As: Name Of The Article, Manufacturers Name, List Of Ingredients, Shelf Life. The Subject Of The Order Covered By Each Batch Of Deliveries Must Be Be Fresh And Of The Highest Quality, Approved For Trading In Accordance With Applicable Standards, Certificates, And Best-Before Dates, And Delivered No Later Than Halfway Through The Shelf-Life Intended For A Given Product, With The Reservation That: Bread And Confectionery Products Will Be Produced On The Day Of Delivery. The Delivered Products Must Comply With The Description Contained In The Submitted Offer Referred To In This Agreement, And In The Case Of Delivery Of An Equivalent Product, The Ordering Party Requires That The Packaging Of This Product Contains All Information Enabling Identification Of The Fulfillment Of The Indicated Minimum Requirements (Parameters) For A Given Product (Weight, Percentage Of Individual Ingredients, Yield From The Packaging, Nutritional Value, Etc.)
