Work Detail 21/01/2021 16:49 (CPT) - Power Project Management Unit 1 - Vietnam Electricity Branch (Procuring Entity) is evaluating technical proposals of contractors participating in online bidding Package 3XL-HB Relocation of the three-tier port (Phase I) cost more than 65 billion VND. According to the bidders reflection, the Procuring Entity issued 2 forms of bid guarantee with different contents (1 template in webform and 1 form attached in currency). However, at 6:00 a.m. on December 1, 2020, the bid solicitor announced the deadline for bid submission extension until 10:00 p.m. on December 4, 2020. The contractor reflected that, Package 3XL-HB did not modify the bidding documents (Bidding Documents) but for no reason, the Procuring Entity renewed it at the "last hours", causing the bidder to "struggle. v ”resurfacing bids accordingly (extending the validity of the bid guarantee, amending some contents of the validity of the bid…). Five contractors have submitted their bids, including: Joint venture of Song Da Investment and Construction Joint Stock Company - Van Hong Hydropower Joint Stock Company; Joint Venture of Traco 18 Joint Stock Company - Pusco Group Joint Stock Company; Joint Venture of Lung Lo Construction Corporation - Lung Lo 4 Construction Joint Stock Company; Joint Venture of Tan Thanh Trading and Construction One Member Company Limited - Ha Noi Water Construction Construction Joint Stock Company; Joint Venture of Waterway Construction Joint Stock Company - Waterway Construction Corporation. 5 contractors are proposing a contract execution time of 8 months. According to the bidders reflection, the Bid solicitor uses 2 different Bidding Documents to post on the electronic Government procurement system (1 file on the webform and 1 file attached), leading to inconsistent content of the Bidding Documents. . Specifically, Form No. 07B guarantees the bid in 2 files: one side is "The guarantor commits to definitely pay the beneficiary an amount of money ...", and the other side is "The guarantor commits uncontrollably. lawsuit, irrevocable and does not require the contractor to consider… ”. Pursuant to Circular 04/2017 / BKH-DT detailing the selection of contractors through the electronic Government procurement system, the contractor has acted as a bid guarantee according to information in the webform. However, when requesting a bidder to clarify the bids guarantee, the soliciting entity re-evaluates the bid according to the Bidding Documents attached to another file. A reporter of the Bidding newspaper contacted the Power Project Management Board 1 to clarify the discrepancy in the two forms of bid guarantee posted on the electronic Government procurement system, the basis of application evaluation. Which form is the form used by the Procuring Entity (posted on webform or attached file). However, the staff of the Procuring Entity affirmed that these 2 forms were not different and refused to clarify by phone. Talking to reporter of Bidding newspaper, TS. Nguyen Viet Hung - bidding expert said, when organizing online bidding, in case there is any discrepancy between information in the attached file of Bidding Documents issued by the bid solicitor on the electronic Government procurement system and other information on webform, information in webform is the basis for bidders to prepare bid. This provision is clearly stated in Circular 04/2017 / BKH-ÐT. Besides, Clause 2, Article 10 of Circular 04/2017 / BKH-ÐT also states that, after completing the Bidding Documents, the Bid solicitor prints the Bidding Documents and submits them to the Investor for appraisal and approval. The Procuring Entity is responsible for the consistency between the Bidding Documents on the electronic Government procurement system and the Bidding Documents approved by the Investor.
