Work Detail The Public Procurement Office draws the attention of the contracting authorities to the purchases of reagents for medical equipment (renting), taking into account the comments of market participants, on the issues raised by these purchases. Contracting authorities, when formulating requirements for medical equipment, often refer in the technical specifications to the proposed new, unused analyzer or indicate the specific year of manufacture of the equipment, which indicates that the proposed analyzer should be new. The willingness of contracting authorities to use the most recent, unused equipment for conducting research is understandable and seems logical, but contracting authorities must also assess that such requirements are likely to affect the price of the suppliers offer, in which case it may be higher. It should be noted that the analyzers usually have a lifetime of 5-7 years, while contracting authorities usually have a contract period of up to 3 years. At the end of the contract (after 3 years), the contracting authorities publish a new public procurement and include the same requirements for the equipment in the purchase conditions and again oblige the suppliers to offer only new and unused equipment. By imposing similar requirements on all contracting authorities, suppliers are not yet in a position to offer equipment that is quite good and reliable to any contracting authority, so that bids may be forced to raise the cost of research (reagents) to fully cover the cost of the analyzer over a 3 year contract. Against this background, the Authority reminds contracting authorities that, in accordance with Article 86 (5) of the PPAs, a contract may be concluded for a period longer than 3 years in justified cases where, in view of the characteristics of the object to be purchased and the rational use of funds, it is necessary to extend the supply of goods, services, \ t for the period of execution of works, for example as referred to in paragraph 11 of this paragraph, where goods and / or services where the period of supply of goods and / or services over 3 years is economically or socially more beneficial and justified by the contracting authority. If, however, 3-year contracts are concluded, it is recommended that contracting authorities assess the possibility of allowing suppliers to offer non-new equipment by establishing reliability, permissible errors or other parameters for the analyzer. Article 17 (2) (1) of the PPA provides that the contracting authority shall ensure that the funds allocated for the purchase of goods, services or works are used rationally, so that the contracting authority shall on a case-by-case basis justify the need for analyzers to assess their needs and costs.
