Work Detail The mayor of Valjevo, Slobodan Gvozdenovic, has announced the public procurement of information services for which the budget foresees 4,15 million dinars. About this public procurement is contrary to the law, wrote Kolubarske.rs , we also expressed suspicion that the business was arranged in advance with the "bidder", whose name is "known to the mayor". Five associations of journalists warned the town of Valjevo that the financing of the information service was not in accordance with the Law on Public Information and the Media, asking the Mayor Slobodan Gvozdenovic to suspend this public procurement. Journalists associations pointed out that, in accordance with the Law on Public Information and Media, the production of media content is co-financed exclusively through public tenders, and not through public procurement. Nevertheless, Mayor Slobodan Gvozdenovic did not give up on public procurement of information services. Kolubara decided to participate in this public procurement in order to have more rights, such as monitoring of tender procedures, insight into the documentation of all bidders, as well as because as a participant in the tender we have more rights before the competent authorities. Also, the desire was to show in the practical case of a public procurement the merits of our suspicion that the authorities violate the laws and abuse their position and money of the citizens, but also to show what kind of attitude towards such conduct of the authorities, competent institutions such as the Ministry of Culture and Information, the Commission to protect the rights of bidders, police, prosecutors and courts in the protection of legality and prevention of abuse. The tender documentation of the public procurement of the information service states that the public opening of the bids will be held on March 15 at 10 am, the city - the City Administration, the small hall, the first floor. The representative of Kolubara, as a bidder, arrived at the appointed place ten minutes earlier. One minute before ten, a part of the building where the mayors cabinet came, later turned out, two members of the Public Procurement Commission and Zoran Majdak. They walked past the small sale and went through the assembly hall to the other wing of the building. Since the Public Procurement Commission did not appear in a small hall until 10.05 am, our representative was searching for the City Administration. In the hall he met an official who asked if he knew where the opening of the public procurement for information services was? After inquiring, the clerk informed him that bids were opened at the public procurement office in the other part of the building. When the representative of Kolubara entered, the office already had two members of the Commission and Zoran Majdak. In a small office, representatives of Kolubara were accommodated for a small conference table, and right next to him stood Zoran Majdak leaning against a window with his arms crossed. Our representative addressed the Commission: "Ask the gentleman to sit down so that he does not stand above my head". Zoran Majdak reacted to this with insults: "Come Tearing Media", then added "you do not have a head," and stayed standing. Nobody from the Commission reacted, and on the question of our representative: "Do you hear this and is it okay," Commission President Aleksandar Djuric answered in vain: "We have not started yet". He said this at a time when he already legitimized the attendees, whose names were included in the tender opening minutes, including Zoran Majdak whom Djuric presented as "other interested persons". Besides insult you will be disabled in every possible way! The representative of Kolubara has long held an unequal fight with the chairman of the commission, Aleksandar Djuric, to include in the record that the opening of tenders instead of at 10 oclock, started at 10.10, that the place of opening of the bids was changed and that nobody had informed anyone about it. (Except Zoran Majdak, Prim.aut.) Despite the right of the authorized bidder to bring his remarks to the record, President Ðuric persistently insisted that the record be entered in the record what he thinks should be, and not the remarks as the bidder had made. When our representative realized that the discussion was meaningless and that he did not take anything, he stopped and the bidding continued to open. The offer of Kolubara with a price of 3,999,996 dinars without VAT was, of course, incomplete, as stated in the minutes. We decided that our bid would be incomplete because we did not want to win on that tender because we would never conclude a contract that is contrary to the law. The second received offer was In Network Solution doo, Novi Beograd with a price of 4.140.000 dinars excluding VAT. Commission President Aleksandar Djuric noted that for this offer there were signed and certified forms, as well as supporting documents, which he otherwise did not review, there were some papers on the camera, but none of them was recorded in the minutes. Considering that the tender required that the bid part of the tender be: contract with one TV, six radio stations, one publisher of a high-profile daily and at least five informative internet portals, the representative of Kolubara requested access to the documentation, precisely in those contracts to which the Chairman of the Commission did not inspect. In Article 104 of the Law on Public Procurement, paragraph 1, point 10, in the chapter on the opening of bids, states that the "noted shortcomings in bids" are recorded in the minutes. Given that it is impossible to spot the flaws without insight into the offer, our representative insisted that he review the documentation. However, the President of the Commission put both hands on the offer and persistently refused to provide the documentation. When a representative of Kolubara realized that this would not be allowed, he demanded that a note be included in the record that he was not allowed to inspect the documentation, and again had the same problem that his remark would be faithfully entered in the record. Commission President Aleksandar Djuric briefly released a member of the Commission, who led the minutes, said: "Put in the record to the authorized bidder is not allowed to inspect the documentation other than the bid form". He soon realized that he had dictated something that was not needed and that in the later procedure he could be a problem and quickly added: "We will not write anything, Swallow it and print it out!" (Print the record, cf. Kolubarske.rs have all about this with a tone record. Tender filed for Zoran Majdak? We are fundamentally suspicious that the conditions for public procurement of public information services are exactly what they are like to correspond with Zoran Majdak, because the number of media is required according to the type and number of Majdak controlled or in some way connected with them. Considering that the estimated value of the public procurement is 4,158,333 RSD without VAT, and without the defined amount of services that will be provided for this money, we are reasonably doubtful that the entire procurement procedure has corrupt elements. We also suspect that the mayor, who has issued this public procurement, does not prevent anything from accepting any amount of service. Since Slobodan Gvozdenovic is persistent in realizing this public procurement, despite the warnings that he is not in the law, we also suspect that he will share with Zoran Majdak his "good friend". Doubts are based on several facts. First of all, the fact that Zoran Majdak attended the opening of bids as an interested person and that he had a "bureaucratic" relationship with the Public Procurement Commission. Furthermore, the Commission has covered the documentation of In Network Solution doo Novi Beograd, giving them the time to eliminate possible deficiencies in the decision-making process, and the fact that Zoran Majdak has previously operated with the City through the company In Network Solution.
