1. The Subject Of The Order Is The Task: Renovation Works And Removal Of Rainwater Failure - In The City Of Giżycko. 2. The Basic Scope Of Works Includes In Particular: A) Earthworks, Demolition And Surface Works, B) Mounting, Renovation And Removal Of Failures On Pipelines And Rainwater Elements, C) Cleaning The Elements Of The Storm Sewage Network. A Detailed Description Of The Subject Of The Contract Is Included In Annex 9 To Swz Description Of The Subject Of The Contract And Annex 10 To Swz Technical Specifications For The Execution And Acceptance Of Construction Works (Stwiorb). 3. Conditions Regarding The Performance Of The Contract Were Specified In The Planned Provisions Of The Contract Constituting Annex 7 To Swz.4. The Employer Requires Special Caution In Conducting Works, In Particular To Ensure Adequate Security And Covers, Keeping The Construction Site In Good Order, Organizing Construction Works In A Way That Does Not Show People Using Real Estate Neighboring Real Estate. In Connection With The Above, The Contractor Must Take Into Account The Costs Of Securing Works In The Price Of The Offer. This Cost Should Be Included In Indirect Costs. 5. The Ordering Party, Pursuant To Art. 95 Of The Public Procurement Law, Requires Employment By The Contractor Or Subcontractor On The Basis Of An Employment Relationship, Persons Performing Activities In The Scope Of The Performance Of The Contract, The Performance Of Which Consists In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of 26 June 1974 - Labor Code (Vol. Journal Of Laws Of 2025, Item 277). The Above Employment Requirement On The Basis Of An Employment Relationship Applies To Manual Workers Who Directly Perform Construction Works Covered By The Subject Of The Contract In The Scope Of: A) Earthworks, Demolition And Surface Works, B) Assembly, Renovation And Removal Of Failures On Pipelines And Elements Of The Rainwater Sewage System, C) Cleaning The Rainwater Sewage Network Elements. The Above Requirement Does Not Apply To People Performing Free Competitions, Including Designers, Construction Manager And Work Managers. 6. The Ordering Party At Every Stage Of The Subject Of The Contract Has The Right To Demand That The Contractor Prove The Fact Of Employment Of Persons Under An Employment Contract. 7. In The Event Of Justified Doubts As To The Observance Of The Labor Law By The Contractor Or Subcontractor, The Employer May Ask For An Inspection By The National Labor Inspectorate. 8. Detailed Requirements For The Implementation And Enforcement Of The Employment Requirement On The Basis Of An Employment Relationship Were Specified In The Planned Provisions Of The Contract, Constituting Annex 7 To Swz.
