The Subject Of The Order Is Construction Work Consisting In The Performance Of Design And Construction Works For The Investment Task Entitled: Reconstruction Of The Dąbrowa Białostocka Railway Station In The Design And Build System Along With Authors Supervision Over The Implementation Of Construction Works Based On The Prepared Design Documentation. 2. The Description Of The Subject Of The Order, Hereinafter Referred To As Opz, Is Annex No. 1 To The Swz - Functional And Utility Program, Hereinafter Referred To As Ffu, Together With Annexes. 3. The Contractor Is Obliged To Complete The Order On The Terms And Conditions Specified In The Template Agreement - Appendix No. 11 To The Swz, Hereinafter Referred To As The Agreement And In The Opz - Appendix No. 1 To The Swz (Pfu With Annexes). 4. The Ordering Party Does Not Plan To Organize A Site Visit With Its Participation, However, It Is Recommended That The Contractor Checks In Great Detail The Conditions For Performing The Subject Of The Order In The Field. 5. The Contractor Or Subcontractor Is Obliged To Employ, Under An Employment Contract, Persons Performing Work Within The Meaning Of Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Consolidated Text: Journal Of Laws Of 2023, Item 1465). The Employment Obligation Applies To Employees Who, Under The Agreement Concluded As A Result Of Awarding The Contract In Question, Will Perform Activities In The Field Of: A) Bricklaying, Painting, Roofing, Activities Performed As A Bricklayers Assistant, B) Assembly Works In The Field Of Sanitary Installations, C) Assembly In The Field Of Electrical Installations, D) Settlement And Keeping Construction Documentation. 6. The Rules For Documenting Employment, Monitoring The Contractors Or Subcontractors Compliance With The Employment Requirements Under An Employment Contract And Provisions Regarding Sanctions For Failure To Meet Them Are Set Out In §4 Section 25 Of The Template Agreement Constituting Annex No. 11 To The Swz. 7. The Requirement Of Employment Under An Employment Contract Does Not Apply To Persons Performing Other Scopes Of Work, In Particular: Developing Design Documentation, Managing Construction, Performing Surveying Services, Suppliers Of Construction Materials. 8. The Ordering Party Requires That During The Execution Of The Order, The Persons Designated By The Contractor To Carry Out The Order, Listed In Chapter Ix Section 2 Point 2.4 Subpoint 2.4.3 Swz Communicated With The Ordering Party In Polish Or Through A Polish Translator. In Correspondence Between The Contractor And The Ordering Party, The Polish Language Is Considered To Be Binding, And In This Case The Ordering Party Requires The Contractors Staff To Use Polish At An Advanced C1 Level - In Accordance With The Scale Adopted By The Council Of Europe - Cefr Common European Framework Or Through A Polish Translator. , While In Correspondence Between The Contractor And The Ordering Party, The Polish Language Is Considered To Be At Least At The Above-Mentioned Level Of Advancement. 9. The Ordering Party Provides For Advance Payments For The Execution Of The Order. Terms And Conditions Of Participation
