A Detailed Description Of The Subject Of The Order Is Specified In The Design Documentation, Bill Of Quantities And Technical Specifications For The Execution And Acceptance Of Construction Works Constituting Annex B To This Swz.3. The Method Of Implementing The Subject Of The Order Is Also Determined By The Content Of The Draft Contract Constituting Annex A To This Swz.4. The Ordering Party In Accordance With Art. 121 Of The Act - Pzp Reserves The Obligation For The Contractor To Personally Perform The Key Part Of The Order, I.E.: A) Conservation Works On The Brick Wall; B) Conservation Works On The Interior Of The Corner (Round) Tower; C) Maintenance Works On The Roof Truss Of The Shell Tower.5. In The Case Of Contractors Jointly Applying For The Contract, One Of Them Is Obliged To Personally Perform The Key Part Of The Contract Indicated In Point 5.4 Of The Swz. Note: With Respect To The Key Tasks Specified In Point 4, The Contractor Must Perform Them Personally. In This Respect, The Contractor Cannot Rely On The Resources Of Other Entities And Cannot Entrust This Part Of The Order To Subcontractors.6. The Ordering Party Allows The Use Of Equivalent Solutions In The Scope Of Performance Of The Subject Of The Order In Accordance With Polish Standards Transposing European Standards, And In The Absence Thereof, Legal Provisions Specified In Art. 101 Section 1-3 Of The Public Procurement Law Act.7. If The Documentation (In Particular: Design Documentation, Bill Of Quantities, Stwiorb) Shows That The Materials Or Equipment Come From A Specific Manufacturer, The Ordering Party Allows The Use Of Equivalent Solutions Provided That They Guarantee The Correct Implementation Of The Works And Ensure The Achievement Of Technical Parameters Not Worse Than Those Assumed In The Above Listed Documents, Materials Or Devices From Specific Manufacturers Determine The Minimum Quality Parameters And Functional Features, As Well As Qualitative Features (Including Dimensions, Composition, Material Used, Color, Shade, Purpose Of The Materials Or Devices, Aesthetics, Etc.)8. The Contractor Who Relies On Equivalent Solutions Referred To In Points 6 And 7 Is Obliged To Demonstrate That The Products/Materials He Offers Meet The Requirements Specified By The Ordering Party.9. If The Contractor Proposes To Change The Materials Or Devices To Equivalent Ones, It Is Required To Submit, Together With The Offer, Documents Indicating The Technical Parameters Of These Materials Or Devices, Which Will Clearly Show That They Are Fully Equivalent To The Solutions Indicated In The Design Documentation.10. Pursuant To 95 Section 1 Of The Act - Public Procurement Law, The Ordering Party Requires The Contractor To Employ, Under An Employment Contract, Persons Performing Work In The Scope Of This Order, In Particular Physical Work Related To Conservation Works And Construction Works, Including Work In The Operation Of Machines And Devices. The Indicated Requirements Apply To Persons Employed By The Contractor, As Well As By Subcontractors.11. The Method Of Documenting The Employment Of The Persons Referred To In Point 10 And The Ordering Partys Rights To Control Whether The Contractor Or Subcontractor Meets The Above Requirements. Requirements, And Sanctions For Failure To Meet These Requirements Are Included In The Draft Agreement Constituting Annex A To The Swz.
