Pursuant To The Content Of Art. 95 Section 1 Of The Public Procurement Law, The Ordering Party Requires Employment By The Contractor Or Subcontractor Under An Employment Contract Within The Meaning Of The Act Of June 26, 1974 - Labor Code (Consolidated Text: Journal Of Laws Of 2023, Item 1465, As Amended. ), Persons Performing Activities Related To The Implementation Of The Subject Of The Order. A) The Requirement Does Not Apply To Activities Performed By Persons Managing The Construction Site: Construction Manager, Works Manager And Other Persons Performing Independent Technical Functions In Construction, Persons Performing Surveying Services, Suppliers Of Construction Materials. The Employment Requirement Referred To Above Also Does Not Apply To Persons Who Have Authorizations Issued Under Other Regulations That Authorize Them To Perform Work Independently Without Supervision. B) On The Day Of Signing The Contract, The Contractor Is Obliged To Submit A Declaration Of Employment Under The Employment Contract Of Persons Performing The Activities Referred To In Referred To In Point 4. The Contractor Will Prepare And Submit To The Ordering Party During The Final Acceptance Of The Works (2 Sets In Writing, Permanently Attached And 2 Copies Saved On A Cd) All Documents For The Completed Subject Of The Order, In Particular: A) Materials Testing Reports, B) Documents Confirming The Quality Of The Materials And Devices Used To Perform The Subject Of The Order, C) Other Documents Collected During The Execution Of The Subject Of The Order And Relating To Its Implementation, Especially Drawings With Changes Made During The Task, D) As-Built Design, E) As-Built Geodetic Inventory (In Accordance With The Requirements In Stwior),F) Other Documents Necessary To Report The Completion Of The Works.11. Under This Order And The Offer Price, The Contractor Will Be Obliged To Perform And Ensure: A) Efficient Organization And Management Of The Construction Site, B) Health And Safety And Fire Protection Conditions Consistent With Legal Provisions, C) In The Case Of Using Subcontractors, Coordinate The Works Of Subcontractors, Bearing The Responsibility For Them. Full Responsibility, D) Ensuring Technical Supervision Over The Task Being Performed, Supervision Over The Staff In Terms Of Work Order And Discipline, E) Proper Maintenance Of Construction Documentation, F) During The Execution Of The Order, Ensuring That All Materials Used To Complete The Subject Of The Contract Have Marketing Authorization And Appropriate Declarations Of Compliance With Applicable Standards In This Area. The Contractor Will Provide The Above-Mentioned Documents At The Request Of The Ordering Party Upon Final Acceptance. The Installation Of Any Materials And Equipment That Do Not Have Valid Certificates Is Excluded, G) Requirements For The Works - All Works Should Be Carried Out In Accordance With Applicable Regulations, Applicable Standards, Technical Conditions And Construction Practice, Occupational Health And Safety And Fire Protection Regulations. With The Recommendations Of The Employers Inspector, And In Accordance With The Requirements Of The Design Documentation And The Guidelines Of This Specification, As Well As Other Annexes, H) The Contractor Is Obliged To Restore The Proper Condition And Order Of The Construction Site, As Well As (If Used) Roads, Real Estate, Devices, Facilities, Etc. ., Which The Contractor Violated When Performing The Subject Of The Order.12. The Ordering Party Requires That In The Event Of Entrusting Part Of The Order To Subcontractors, The Contractor Should Indicate In The Offer The Parts Of The Order Whose Performance It Intends To Entrust To Subcontractors And Provide The Names Of Any Subcontractors, If Known.15. The Ordering Party Does Not Require The Contractor To Carry Out An On-Site Visit Or Check The Documents Necessary To Perform The Order, Referred To In Art. 131 Section 2 Of The Act.16. Settlements Between The Ordering Party And The Contractor Will Be Made Only In Polish Currency.17. Reference To Specific Manufacturers, Contractors And Suppliers In The Project Documentation Is Illustrative And Only Concerns The Technical Parameters And Characteristics Of The Devices And Materials Used In The Project (Resulting From The Design Solutions) And Does Not Constitute An Obligation To Select These Manufacturers As Suppliers And Contractors. Equivalent Solutions Are Allowed In This Respect, I.E. Those With Technical Parameters Not Worse Than Those Required In The Design Documentation. If Equivalent Solutions Are Offered, The Contractor Is Obliged To Demonstrate The Equivalence Of The Offered Solutions.18. If The Procedure Documentation Contains References To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Act, Equivalent Solutions Are Allowed Provided That The Contractor Proves In The Offer, In Particular By Means Of Evidence Referred To In Art. 104-107 Of The Act, That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Contract.19. Whenever In The Description Of The Subject Of The Contract There Are References To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems, The Phrase Or Equivalent Is Added After Their Wording.20. A Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Their Description Or Standards.
