A Detailed Description Of The Subject Of The Order And The Scope Of Construction Works Necessary To Be Performed Are Specified In The Design And Technical Documentation, Which Includes: 1) Architectural, Construction And Executive Design: Renovation Of Selected Rooms In The Building Of The District Office In Jarosław In The Construction And Electrical Industry / Technical Design, Which Include Part Of The Scope Of Construction Works For Stage I (First) And The Entire Scope Of Construction Works For Stage Ii (Second);2) Architectural And Construction Design: Renovation Of Rooms In The Historic Building Of The District Office In Jarosław, Taking Into Account Aspects Of Architectural And Construction Accessibility, Which Covers The Remaining Part Of The Scope Of Construction Works For Stage I (First) And The Entire Scope Of Construction Works For Stage Iii (Third);3) Decisions: A) Decision Of The Jarosław Staroste No. 513/2022 Of November 15, 2022 (Reference Number: Ab-Aab. 6740.575. 2022) - Building Permit, B) Decision Of The Podkarpackie Provincial Conservator Of Monuments Of August 28, 2022, Reference Number: Inr-Ii.5142.6.27.2022.Pg, C) Decision Of The Podkarpackie Provincial Conservator Of Monuments Of February 30, 2024 R., Reference Number: Inr-Ii.5142.2.2024.Mf;4) Bills Of Quantities Prepared For Individual Stages Of Construction Works;5) Technical Specifications For The Execution And Acceptance Of Construction Works.6. The Quantitative Scope Of Construction Works Necessary To Be Performed Under The Order Is Specified In Detail In The Bills Of Quantities Prepared For Individual Stages Of The Implementation Of Construction Works Constituting The Subject Of The Order And Being Elements Of The Design And Technical Documentation, Constituting Annex No. 1 To The Swz. 7. Bills Of Quantities, I.E. Both Their Scope And The Measurements Included In Them, Constitute The Basis For Preparing An Accurate Valuation Of Construction Works Constituting The Subject Of The Order, In The Form Of Bid Cost Estimates Submitted With The Offer, As They Will Be Binding Both For The Contractor And The Ordering Party At The Stage Execution. All Works Described In The Bill Of Quantities Should Be Valued.8. In The Event Of Differences Between The Design And Technical Documentation Referred To In Section 5, And The Bills Of Quantities Referred To In Section 6, The Valuation Should Assume That The Subject Of The Order In Terms Of The Quantity And Type Of Construction Works Necessary To Be Performed Under The Order Are Specified In The Bills Of Quantities.9. As Part Of The Execution/Execution Of The Order, In Accordance With The Provisions Of The Swz And The Contract Concluded For The Execution Of The Order, The Contractor, With Its Own Efforts And At Its Own Expense: 1) Will Provide A Construction Manager With Appropriate Qualifications To Manage The Construction Site And The Necessary Construction Licenses, In Accordance With The Provisions Of The Act Of July 7 1994 Construction Law And Authorization To Manage Construction / Construction Works On Immovable Monuments Or Meeting The Requirements Referred To In Art. 37C Of The Act Of 23 July 2003 On The Protection And Care Of Monuments And Belonging To The Appropriate Chamber Of Professional Self-Government And Having The Required Civil Liability Insurance; 2) Will Provide A Works Manager For The Electrical Industry With The Necessary Construction Qualifications, In Accordance With The Provisions Of The Act Of 7 July 1994 Construction Law And Authorization To Manage Construction Works On Immovable Monuments Or Meeting The Requirements Referred To In Art. 37C Of The Act Of 23 July 2003 On The Protection And Care Of Monuments And Belonging To The Appropriate Chamber Of Professional Self-Government And Having The Required Civil Liability Insurance; 3) If Necessary Or Required By Law, Will Provide Other Managers Of Industrial Works Who Have The Necessary Construction Licenses, In Accordance With The Provisions Of The Act Of July 7, 1994 Construction Law And Authorizations To Manage Construction Works On Immovable Monuments Or Monuments Meeting The Requirements Referred To In Art. 37C Of The Act Of 23 July 2003 On The Protection And Care Of Monuments And Those Belonging To The Relevant Chambers Of Professional Self-Governments And Having The Required Civil Liability Insurance; 4) If Necessary Resulting From Legal Provisions, Will Submit Notifications For The Acceptance Of Completed Construction Works Or Works Renovation Works To The Relevant Inspections, Services And Guards, And Will Pay Fees For The Acceptance Of Completed Construction Or Renovation Works By The Relevant Inspections, Services And Guards.10. The Contractor Will Be Obliged To: 1) Provide The Ordering Party With A Warranty And Quality Guarantee For The Completed Subject Of The Order (Construction Works) For The Period Declared By The Contractor In The Submitted Offer, Counted From The Date Of Acceptance Of The Entire Subject Of The Order Without Reservations, Which Cannot Be Shorter Than 36 Months, With Except For A Stair Platform Adapted For Disabled People, Which Must Be Covered By At Least A 60-Month Warranty Period; 2) Properly Handle Waste Intended For Disposal, I.E. In The Manner Specified In The Provisions Of The Act Of December 14, 2012 On Waste And The Act Of September 13 1996 On Maintaining Cleanliness And Order In Municipalities;3) Manage On Its Own The Materials From Dismantling And Waste Generated In The Course Of Its Own Works And Bear The Costs Of Their Removal Together With The Costs Of Storage And Disposal;4) Bear All Costs Necessary For The Proper Performance Of The Order , Including All Fees Related To The Performance Of The Contract, Previously Unforeseen And Arising During Or As A Result Of The Implementation Of Works / Works Related To The Execution Of The Order / Contract; 5) In The Event Of A Need To Perform Replacement Works, To Perform Them Without Charging The Ordering Party With Additional Unjustified Costs ;6) If It Is Necessary To Perform The So-Called Additional Works, To Be Performed On The Basis Of The Same Price Factors (R, S, Kp, Kz, Z) That Will Be Shown In The Bid Cost Estimate, And If There Are No Such Price Factors In The Submitted Bid Cost Estimate And Their Interpolation Or Extrapolation Is Not Possible , Based On Price Factors Included In The Current Sekocenbud Price Lists For The Podkarpackie Voivodeship.11. Requirements For Devices Delivered And Installed As Part Of The Order: 1) Devices Delivered And Installed As Part Of The Order Must Be: A) High-Quality Products That Meet Applicable Standards And The Requirements Of The Ordering Party, B) Brand New, Never Used Before, Showing No Traces Of Use , C) Not Affected By Any Physical Defect And Free From Third Party Rights;2) The Ordering Party Does Not Allow The Contractor To Deliver And Install Devices That Are Exhibition Or Demonstration Products;3) All Devices Delivered And Installed As Part Of The Execution Of The Subject Of The Order Must Have Operating Instructions, And Those That Require It, Also: Technical And Commissioning Documentation (Dtr), Technical Approvals, Ce Declarations Of Conformity, Necessary Safety Certificates Specified In Separate Regulations Or Compliance Protocols With Applicable Standards And Other Documents Required For This Type Of Devices, As Well As Warranty Cards ;4) Guarantees (Warranty Cards/Conditions) For The Devices Delivered And Installed By The Contractor Will Automatically Become Provisions Of The Contract For The Execution Of The Order And, With The Exception Of Extending Their Validity Period, May Not Be Changed.12. The Contractor Will Be Obliged To Perform The Subject Of The Order In Accordance With Applicable Law, The Provisions Of The Swz, The Provisions Of Its Own Offer And The Conditions Specified In The Provisions Of The Draft Agreement, Constituting Annex No. 9 To The Swz.
