If The Technical Documentation, Stwior And Bill Of Quantities Contain The Name Of The Manufacturer Or Company, The Ordering Party Reserves The Right To Use Other Equivalent Materials, But With Parameters No Worse Than Those Described In The Documentation, Stwior And Bill Of Quantities. 5.1. Pursuant To Art. 101 Section 4 Of The Pzp, The Ordering Party Allows Solutions Equivalent To Those Described In The Swz By Means Of Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Pzp, If They Allow To Obtain Features Or Parameters Not Worse Than Those Mentioned. 5.2. Pursuant To Art. 101 Section 5 Of The Pzp, The Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Prove In The Offer That The Proposed Solutions Meet The Requirements Specified In The Description Of The Subject Of The Order To An Equivalent Extent. 5.3. Whenever The Swz Indicates A Material Trademark, Patent Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, The Contractor May Use The Indicated Or Equivalent Other Material That Meets The Technical Requirements Indicated By The Ordering Party. Whenever This Specification Describes The Subject Of The Order Using Standards, Approvals, Technical Specifications And Reference Systems, The Ordering Party Allows Solutions Equivalent To Those Described. The Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate That The Supplies He Offers Meet The Requirements Specified By The Ordering Party. Equivalent Solutions Should Be Understood As Solutions Guaranteeing Parameters Not Worse Than Those Specified In The Swz. The Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate That The Supplies Or Materials He Offers Meet The Requirements Specified By The Ordering Party. The Acceptance Of Equivalent Materials By The Ordering Party Will Be Made In Writing On The Basis Of Documents Submitted By The Contractor (Catalog Cards Or Other Documents) Confirming Their Equivalence. 5.4. Note: In Relation To Each Standard Referred To In The Swz, Including The National Standard, The Ordering Party Allows The Use Of An Equivalent Standard. Therefore, Each Phrase Contained In The Swz Referring To A Standard, Norm, Approval, Material, Patent Or Trademark Should Be Read With The Accompanying Note Or Equivalent Taking Into Account The Guidelines And Requirements Specifying The Parameters Of Equivalence Indicated In The Swz.6. The Purchaser Does Not Allow Partial Submissions. 7. The Ordering Party Does Not Envisage Dividing The Order Into Parts. Taking Into Account The Nature Of The Subject Of The Contract, It Should Be Stated That It Is Indivisible. Dividing The Order Into Parts Would Result In Increased Costs, Implementation Difficulties And The Risk Of Delays, And Would Also Be Artificial And Pointless. 8. The Ordering Party Does Not Allow The Submission Of Variant Offers Or Offers In The Form Of Electronic Catalogues.9.
