Roadworks - Execution Of Works For The Investment Objective Modernization Of Road Infrastructure Of County Road 204E Between The Localities Of Mirceștii Noi-Ciușlea-Străjescu-Doaga-Dn24. The Object Of The Contract That Will Be Awarded Through This Public Procurement Procedure Consists In The Execution Of Works For The Investment Objective Modernization Of Road Infrastructure Of County Road 204E Between The Localities Of Mirceștii Noi-Ciușlea-Străjescu-Doaga-Dn24. The Number Of Days Until Which Clarifications Can Be Requested Before The Deadline For Submission Of Offers Is 20 Days. The Contracting Authority Will Respond Only Once To Requests For Clarifications On The 11Th Day Before The Deadline For Submission Of Offers. Suspense Clause: The Procedure For Awarding The Public Procurement Contract Is Initiated Under This Suspensive Clause, In The Sense That The Conclusion Of The Public Procurement Contract Is Conditional On The Allocation Of Budget Credits For This Purpose, The Signing Of The Contract Being Done In Compliance With The Provisions Relating To The Commitment Of Expenses From The Budgets That Fall Under The Legislation On Public Finances. Considering The Provisions Of Law 98/2016 On Public Procurement And H.G. No. 395/2016, With Subsequent Amendments And Additions, The Contracting Authority States That It Will Conclude The Contract With The Bidder Declared The Winner Only To The Extent That The Funds Necessary For The Purchase Will Be Secured By Allocating Budget Commitments/Credits For This Purpose. If, Regardless Of The Reasons, The Budget Commitments/Credits Will Not Be Allocated, For A Period Of 12 Months From The Date And Final Resolution Of Any Appeals, The Allocation Procedure Will Be Canceled By Law, In The Conditions Where There Is No Other Source Of Financing, In Accordance With The Provisions Of Art. 212 Para. (1) Lit. C) Sentence 2 Of Law 98/2016 With Subsequent Amendments And Additions, It Being Impossible To Conclude The Public Procurement Contract. Bidders In This Procedure Understand That The Contracting Authority Cannot Be Held Liable For Any Damage In The Event Of The Cancellation Of The Award Procedure, Regardless Of Its Nature And Regardless Of Whether The Contracting Authority Has Been Notified Of The Existence Of Such Damage. Bidders Within This Procedure Accept The Use Of The Above Special Conditions/Suspensive Clause, Assuming Full Responsibility In Relation To Any Damages They May Suffer In The Described Situation. The Maximum Period For Which The Suspensive Clause Operates Is 12 Months, So That If The Condition Of Signing The Financing Contract Is Not Met, The Award Procedure Is Cancelled. Bidders In The Procedure Assume By Submitting The Bid The Obligation To Extend The Validity Of Their Bid, At The Simple Request Of The Contracting Authority, If It Will Be In The Situation Of Applying The Suspensive Clause.
