C) Access Cuts To Individual Plots Cannot Be Longer Than 8 Hours At A Time.6. Equivalent Solutions1) The Contractor Will Perform The Subject Of The Order In Accordance With Applicable Regulations, In Particular In Accordance With The Construction Law (Consolidated Text: Journal Of Laws Of 2023, Item 682).2) Proper Names Of Manufacturers Indicated By The Ordering Party Are Not Binding On The Contractor And Should Be Treated As As Examples To Determine Parameters And Technical Requirements. The Types Of Materials And Devices Adopted (Indicated In The Technical Documentation) Were Used Only As Examples To Describe The Subject Of The Order. 3) The Contractor Is Entitled To Present In Its Offer Equivalent Materials And Devices, With No Worse Parameters, Indicated In The Description Of The Subject Of The Order. 4) The Contractor Should Specify Their Parameters In Order To Demonstrate That They Meet The Conditions Specified In The Description Of The Subject Of The Order. Equivalent Solutions, According To Their Definition, Must Have Parameters And Meet Standards No Worse Than The Products Given As An Example. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Their Description Or Standards.5) The Term Or Equivalent Applies To The Trademarks, Patents Or Origin Indicated In The Design Documentation And In The Technical Specifications For The Execution And Acceptance Of Construction Works, Which Means That The Contractor May Use Products Other Than Those Specified In The Design Documentation And In The Technical Specifications For The Execution And Acceptance Of Construction Works, But Only Provided That They Have The Same Functional Nature (Identity Of Function) And That They Will Ensure Technical Parameters And Safety Of Use Not Worse Than Those Assumed In The Above-Mentioned Documents After Obtaining The Ordering Partys Approval. 6) In The Place Where The Ordering Party Describes The Subject Of The Order Using Standards, Approvals, Technical Specifications And Reference Systems Referred To In Article 101 Of The Public Procurement Act, The Ordering Party Allows Solutions Equivalent To Those Described.
