Requirements: 1) The Ordering Party Requires That: A) Food Being The Subject Of The Order Met The Quality Conditions In Accordance With Applicable Certificates, Polish Standards, Food Law And The Applicable Principles Of Gmp/Ghp, Gap And The Haccp System Or The Food Safety Management System In Accordance With Iso 22000:2005, B) The Contractor Provided The Ordering Party With A Guarantee Of The Health Quality And Durability Of The Supplied Food Until The Date Of Minimum Durability Or Use-By Date Specified On Legible Labels, C) Agri-Food Products Were Stored And Transported In A Way That Ensured Their Proper Commercial Quality, D) The Delivered Food Was Marked With A Visible, Legible And Indelible Identification Code And The Expiry Date Enabling Identification Of The Food Item From A Given Production Batch, E) The Contractor Undertakes To Provide All Necessary Information Upon Delivery In Order To Make A Quantitative And Qualitative Assessment Of The Received Food. 2) In The Event Of Receiving Food Of Inappropriate Health Or Commercial Quality, The Ordering Party Will Refuse To Accept It And Will Immediately Report The Complaint In Person Or By Phone On The Day Of Delivery. The Contractor Undertakes To Collect And Replace Food That Does Not Meet The Quality Requirements With One Free From Defects At Its Own Expense, Within The Time Specified By The Contractor In The Offer. The Contractor Signs The Receipt Of Food That Does Not Meet The Requirements. 3) The Contractor Will Deliver Food To The Ordering Party With Its Own Means Of Transport That Meets The Conditions In Accordance With Gmp/Ghp Principles (For Inspection: Approval Of The Means Of Transport For The Transport Of Food) At Its Own Expense And Risk Between 6:30 A.M. The Contractor Is Not Allowed To Leave Food To Unauthorized Persons. The Quantity And Quality Of The Delivered Food Will Be Confirmed By An Authorized Employee Of The Ordering Party. It Is Not Allowed To Accept The Goods Without A Valid Proof Of Delivery, I.E. The Quantity Of The Delivered Goods (Pieces Or Kg), Unit Prices And Values. 5) Food Will Be Delivered On The Basis Of Orders Placed By The Ordering Party To The Contractor By Telephone, E-Mail Or In Person. In The Order, The Ordering Party Will Provide The Type And Quantity Of Ordered Food To Be Delivered. In Special Cases Resulting From The Needs Of The Ordering Party, The Contractor Should Accept An Ad Hoc Order Under Urgent Execution Mode, On The Day Of Demand.6) The Quantities Given In Annex No. 1 Are Estimates For The Purposes Of Calculating The Offer Price. The Ordering Party Reserves The Right To Change The Quantity Of The Ordered Goods In Accordance With The Demand And The Possibility Of Ordering Products Not Indicated In Annex 1.7) The Financial Settlement Of The Contractor With The Ordering Party Will Be Based On The Quantity And Type Of Products Actually Ordered And Delivered To The Ordering Party And Their Unit Prices Applicable To The Contractor In On The Day Of Delivery, Reduced By The Fixed Discount Offered.8) The Method Of Delivery And The Delivered Food Must Comply With All Requirements Of The Food Law.9) The Order Quantities Given In The Description Of The Item Constitute The Estimated Demand That The Ordering Party Expects To Purchase Between January And December 2024, Estimated On The Basis Of The Year 2023. The Contractor Will Not Be Entitled To Any Claims Against The Ordering Party For Failure To Complete The Quantity Of The Subject Of The Order. The Ordering Party May Make A Quantitative Change Specified In The Subject Of The Order, E.G. Due To Low Attendance Of Children And Unforeseen Random Events (Employee Strike, Pandemic, Etc.). The Detailed Quantity Of The Ordered Articles Will Be Determined Each Time By Individual Orders.10) In The Event Of Quantitative Discrepancies Or Poor Quality Of The Delivered Goods, The Contractor Undertakes To Replenish The Quantity Or Replace The Goods With Good Quality Goods Within The Deadline Set By The Ordering Party, So That It Can Be Used In Accordance With The Needs In On The Day He Planned. 11) The Ordering Party Reserves The Right To Purchase The Ordered Goods From Another Supplier In The Event Of Failure To Fulfill The Obligation Specified In Point. 10, Refusal Of Delivery Or Untimely Delivery. The Ordering Party Will Charge The Contractor For The Costs Incurred And Any Costs Of Transporting The Delivery. For The Above Circumstances, A Complaint Report Will Be Prepared And Forwarded To The Contractor.12) It Is Not Envisaged To Grant Advance Payments Towards The Execution Of The Order.13) The Ordering Party Reserves The Right To Suspend The Purchase Of Food Products During The Duration Of The Contract, I.E. Holidays, E.G. July / August Or In The Event Of Closure Kindergartens. In The Case Of Goods With Trade Names, The Word Or Equivalent Applies. Equivalent Products Are Products With Comparable Or Better Parameters, Not Worsened. The Ordering Party Allows The Acceptance Of Other, Equivalent Food Products Than Those Specified In The Tender Documentation, Where Equivalent Means The Use Of Food Products Having The Raw Material Composition Adopted In The Food Products Specified In The Tender Documentation.
