Public Procurement Of Electric Buses With Charging Stations As Part Of The Pnrr Project Equipping With Clean Vehicles For Public Transport In The Municipality Of Sebeş - Stage 2. Supply 8 Electric Buses, Slow Charging Stations (8 Pieces) And Fast Charging Stations (4 Pieces). Electric Buses And Charging Stations Will Serve Public Passenger Transport. The Electric Buses Will Be Solo Type (Non-Articulated), Will Be Equipped With Facilities For The Access Of People With Reduced Mobility, Will Be Without A Floor, Ce Bodywork, Being Intended For Urban Passenger Transport According To Directive 2007/46/Ce, 2009/33/Ce , Unece R 66, Law 92/2007, With All Subsequent Amendments And Additions. In Accordance With The Provisions Of Art. 160 Para. (1) From Law No. 98/2016 With Subsequent Amendments And Additions, The Deadline Until Which Any Interested Economic Operator Has The Right To Request Clarifications Or Additional Information In Relation To The Award Documentation Is 20 Days Before The Deadline For Submission Of Offers; B. In Accordance With The Provisions Of Art. 160 Para. (2) From Law No. 98/2016, With Subsequent Amendments And Additions, The Contracting Authority Will Respond Clearly And Completely To All Requests For Clarifications Within A Single Day, Namely The 11Th Day Before The Deadline For Submission Of Offers, Through A Consolidated Response, Insofar As The Requests For Clarifications Are Transmitted Within The Specified Term. Suspension Clause: The Award/Acquisition Procedure Is Initiated Under This Suspensive Clause, In The Sense That The Conclusion Of The Public Procurement Contract Is Conditional On The Conclusion Of The Financing Contract Within The National Recovery And Resilience Plan, Call For Projects Pnrr/2022/C10 Round 2 , Component 10 Local Fund, With The Ministry Of Regional Development And Public Administration, The Signing Of The Contract Having Been Done In Compliance With The Provisions Regarding The Commitment Of Expenses From The Budgets That Fall Under The Legislation On Public Finances. Considering The Provisions Of Law 98/2016 And Hg No. 395/2016 With Subsequent Amendments And Additions, The Contracting Authority Specifies That It Will Conclude The Contract With The Tenderer Declared The Winner Only To The Extent That The Funds Necessary For The Purchase Will Be Secured By Signing The Financing Contract Within The National Recovery And Resilience Plan, The Call For Projects Pnrr/ 2022/C10 Round 2, Component 10 Local Fund With The Ministry Of Regional Development And Public Administration. If, Regardless Of The Reasons, The Financing Contract With The Ministry Of Regional Development And Public Administration Will Not Be Signed, The Contracting Authority, After Receiving The Notification From The Ministry Of Regional Development And Public Administration Regarding The Non-Granting Of Financing, Reserves The Right To Cancel The Award Procedure, Provided There Is No Other Source Of Funding, In Accordance With The Provisions Of Art. 212 Para. (1) Lit. C) Sentence 2 Of Law 98/2016 With Subsequent Amendments And Additions, It Being Impossible To Conclude The Public Procurement Contract. Bidders Within This Procedure Understand That The Contracting Authority And/Or The Ministry Of Regional Development And Public Administration Cannot Be Held Liable For Any Damage In The Event Of The Cancellation Of The Award Procedure, Regardless Of Its Nature And Regardless Of Whether The Contracting Authority And/Or The Ministry Of Regional Development And Administration The Public Has Been Notified Of The Existence Of Such Damage. Bidders Within This Procedure Accept The Use Of The Above Special Conditions/Suspensive Clause, Assuming Full Responsibility In Relation To Any Damages They May Suffer In The Described Situation.
