If, Regardless Of The Reasons, The Budget Credits Will Not Be Allocated, For A Period Of 3 Months From The Date Of Approval Of The Procedure Report, The Allocation Procedure Will Be Canceled By Law, In The Conditions That There Is No Other Source Of Funding, In Accordance With The Provisions Of Art. 212 Paragraph (1) Letter C) Sentence 2 Of Law 98/2016 With Subsequent Amendments And Additions, It Being Impossible To Conclude The Public Procurement Contract. Bidders Within This Procedure Understand That The Contracting Authority Cannot Be Held Liable For Any Damage In The Event Of The Cancellation Of The Award Procedure, Regardless Of Its Nature And Regardless Of Whether The Contracting Authority Has Been Notified Of The Existence Of Such Damage. Bidders Within This Procedure Accept The Use Of The Above Special Conditions/Suspensive Clause, Assuming Full Responsibility In Relation To Any Damages They May Suffer In The Described Situation. The Maximum Period For Which The Suspensive Clause Operates Is 3 Months, So That, If The Condition Of Signing The Financing Contract Is Not Met, The Award Procedure Is Canceled.
