The Number Of Days Until Which Clarifications Can Be Requested Before The Deadline For Submitting Offers/Candidates: 10 The Contracting Authority Will Respond Clearly And Fully To All Requests For Clarification/Additional Information By The 5Th Day Before The Deadline Set For The Submission Of Offers. Suspense Clause: The Procedure For Awarding The Public Procurement Contract Is Initiated Under This Suspensive Clause, In The Sense That The Conclusion Of The Public Procurement Contract Is Conditioned By The Allocation Of Budget Credits For This Purpose, The Signing Of The Contract Being Done In Compliance With The Provisions Relating To The Commitment Of Expenses From The Budgets That Fall Under The Incidence Of Public Finance Legislation. Considering The Provisions Of Law 98/2016 On Public Procurement And H.G. No. 395/2016, With Subsequent Amendments And Additions, The Contracting Authority Specifies That It Will Conclude The Contract With The Bidder Declared The Winner Only To The Extent That The Funds Necessary For The Purchase Will Be Secured By Allocating Budget Credits For This Purpose. If, Regardless Of The Reasons, The Budget Credits Will Not Be Allocated, For A Period Of 3 Months From The Date Of Approval Of The Procedure Report, The Allocation Procedure Will Be Canceled By Law, In The Conditions That There Is No Other Source Of Funding, In Accordance With The Provisions Of Art. 212 Paragraph (1) Letter C) Sentence 2 Of Law 98/2016 With Subsequent Amendments And Additions, It Being Impossible To Conclude The Public Procurement Contract. Bidders Within This Procedure Understand That The Contracting Authority Cannot Be Held Liable For Any Damage In The Event Of The Cancellation Of The Award Procedure, Regardless Of Its Nature And Regardless Of Whether The Contracting Authority Has Been Notified Of The Existence Of Such Damage. Bidders Within This Procedure Accept The Use Of The Above Special Conditions/Suspensive Clause, Assuming Full Responsibility In Relation To Any Damages They May Suffer In The Described Situation. The Maximum Period For Which The Suspensive Clause Operates Is 3 Months, So That, If The Condition Of Signing The Financing Contract Is Not Met, The Award Procedure Is Canceled.
