The Contracting Authoritys Expectations Regarding The Gravimetric Mixture Infusion And Monitoring System To Be Purchased (Hereinafter: System) Are Determined By The Technical Description Attached As Part Of The Preliminary Market Consultation (Hereinafter: Epk). The Tenderers Task Is To Offer A Complete System Consisting Of Software And Hardware Components With Capabilities Corresponding To The Requirements According To The Technical Description, Which Is Suitable For Use According To The Purposes Of Use Defined By The Bidder, And Which As A Whole And In Its Relevant Components At Least Meets The Minimum Requirements Shown In The Technical Description, Or Better Than These They Have Capabilities. As Part Of The Performance Of The Sales Contract To Be Concluded As A Result Of The Public Procurement Procedure, The Task Of The Winning Bidder Is To Deliver, Install And Commission A Complete It And Laboratory Technology System To The Bidder, Which System Also Includes The Necessary It Hardware And Software Components. The Winning Tenderer Is Also Responsible For Providing The Related Services Specified In The Technical Description And The Draft Contract. The System To Be Purchased Performs The Following Functions In Accordance With The Applicable Legislation And Professional Regulations: Management Of Patient Demographic Data, Determination Of Diagnosis Based On Medical Therapy Planning Protocols, Online Pharmacist Professional Supervision, Gravimetric Production Of Cytostatic Mixture Infusions. Only New (Not Yet In Use) Products And Software Licenses Can Be Offered For All Components And Accessories Of The System. The Applicant Does Not Provide The Opportunity To Deliver Used (Or Even Refurbished) Products Or Software Licenses, So Only New, I.E. Unused, Non-Factory Refurbished And Non-Demo Products Are Allowed To Be Delivered. The Winning Bidder Shall Perform According To The Contract If It Is Determined During The Technical Handover Procedure That Delivers Components That Meet The Minimum Technical Requirements In The Technical Description Or Have Better Technical Properties, And Installs Them In An Organized Manner In The System, Put The Unified System Into Operation For Its Intended Use, Demonstrated The Intended Operation Of The System And Suitable For The Purposes Specified In The Technical Description/Contract During A Test Run, Completed The Training And Education In Accordance With The Contract, Delivered The Functional System Ready For Use, As Well As All The Manufacturers Documentation (Full Instructions For Use, Technical Documentation In English Or Hungarian), As Well As Other Documentation According To The Contract, Was Handed Over To The Bidder. The Winning Bidder Shall, In Accordance With The Contract, Perform The Services To Be Performed After The Successful Completion Of The Handover Acceptance Procedure, If You Meet Your Warranty And Software Version Tracking Obligations In Accordance With The Law And The Contract, And Provides All Related Services To The Bidder In Accordance With The Contract. All Subassemblies Must Comply With The Requirements Laid Down In The Relevant Laws And Standards, As Well As With All Permits Required For Placing On The Market. With Respect To The Delivered Software That Is Part Of The System, The Bidder Acquires Non-Exclusive And Non-Transferable (End-User) License Rights Valid In The Territory Of Hungary At The Bidders Premises Without Time Limitation. During The 60-Month Full Warranty Period, The Winning Bidder Will Provide The Bidder With Periodic Updates Of The System Software Parts (Software Updates, Version Tracking).
