A Detailed Description Of The Subject Of The Order Is Included In The Contract Template With Annexes, Constituting Annex No. 11 To The Swz. 2. In These Proceedings, The Ordering Party Does Not Divide The Order Into Parts And Does Not Allow The Possibility Of Submitting Partial Offers: The Subject Of The Order, I.E. The Provision Of Technical Assistance And Maintenance Services For The Zszo System And Development Services, Cannot Be Divided Into Parts For Technical, Expediency And Economic Reasons, As It Constitutes A Coherent Whole. Dividing The Contract Into Lots Could Lead To Coordination Difficulties, An Increase In The Risk Of Incorrect Provision Of Services And A Threat To The Continuity Of System Operation. The Integrated Nature Of The System Means That The Provision Of Support Services Should Be Provided By One Entity Comprehensively Responsible For The Functioning Of The System. The Lack Of Division Into Parts Does Not In Any Way Limit Access To The Order For Small And Medium-Sized Enterprises, And Contractors Operating In The Industry Covered By The Subject Of The Order May Deliver All Its Elements. 3. The Ordering Party Does Not Require The Execution Of The Order By Sheltered Workshops, Social Cooperatives Or Other Contractors Covered By The Provisions Of Art. 94 Section 1 Of The Act. 4. The Ordering Party, Pursuant To Art. 95 Section 1 Of The Act Requires The Contractor (Or Subcontractor) To Employ, On The Basis Of An Employment Relationship, Persons Performing The Call Center Remote Assistance Service Referred To In Point 5 Of The Annex To The Agreement. Performing These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Consolidated Text: Journal Of Laws Of 2025, Item 277, As Amended). (This Requirement Does Not Apply To Bidders: Natural Persons Running A Business And Partners Of Partnerships Who Undertake To Personally Perform These Activities For The Company.) 5. The Ordering Party Does Not Envisage The Possibility Of Awarding Contracts Referred To In Art. 214 Section 1 Point 7 Of The Act. 6. The Ordering Party Does Not Allow The Submission Of Variant Offers. 7. The Ordering Party Does Not Plan To Conduct An Electronic Auction. 8. The Ordering Party Did Not Conduct Preliminary Market Consultations Before Initiating The Procedure. 9. In These Proceedings, The Ordering Party Does Not Require Contractors To Submit The Said Evidence. 10. The Ordering Party, Within The Limits Specified In Art. 462 Et Seq. The Act Allows For The Execution Of The Subject Of The Order By The Contractor Using Subcontractors.
