Exemptions, Clarifications And Comments Pursuant To Article 9, §4 Of The Royal Decree Of January 14, 2013 Establishing The General Rules For The Execution Of Public Contracts (Hereinafter “The Rge”), The Tenderers Attention Is Drawn To The Fact That These Special Specifications Derogate Due To The Specificities Of The Contract From The Following Provisions: - The Provision Of Services Being Planned On An Annual Basis, The Amount Of The Security (Article 25, §2 Rge) Is Set At 5% Of The Contract Amount For Execution For One Year. - Given That The Nature Of The Contract Requires Rapid Intervention To Enable The Service Provider To Remedy Its Breach Without Delay, The Finding Of Any Failure To Comply With The Contract Clauses On The Part Of The Service Provider (Article 44, §2 Rge) May Be Communicated By The Contracting Authority By Email To The Service Provider, Who Confirms Receipt And Asserts Its Defenses By Email Within 24 Hours. This Exemption Is Necessary Because It Is A Provision Of Services Whose Non-Performance Is Likely To Pose Health And Safety Problems. Rapid Action Is Therefore Required So That The Service Provider Can Immediately Remedy Its Breach. - Given The Nature Of The Contract And The Importance Of The Damage That May Result From Breaches Committed By The Successful Bidder, Article 45, §2 Of The Rge Is Waived, The Maximum Ceiling Of Single General Penalties Being Increased To ...
