The Subject Of The Order Is The Task: Renovation Of The Section Of The Municipal Road No. 104484B In The Town Of Wyk, Including The Renovation Of The Section Of The Municipal Road No. 104484B Consisting In Supplementing And Strengthening The Existing Road In The Village Of Wyk On The Section Of Plot No. 667 (Wyk District) With A Length Of Approx. 2153 M.1. A Detailed Description Of The Subject Of The Order Is Included In The Design Documentation Along With The Bill Of Quantities (Appendix No. 9 To The Swz). 2. The Scope Of The Subject Of The Order Should Be Performed In Accordance With The Above-Mentioned. Design Documentation. The Bills Of Quantities Attached To The Swz Are Auxiliary Materials Intended To Describe The Method And Technology Of Performing The Works. The Contractor Is Obliged To Include In The Offer Price Any Work Not Included In The Bill Of Quantities But Included In The Design Documentation. 3. Use Of Materials, Equivalent Devices: If In Any Place In The Specification Of Essential Terms Of The Contract And Its Annexes, I.E. Design Documentation, Technical Descriptions, Bills Of Quantities, Drawings And Technical Specifications For The Execution And Acceptance Of Construction Works, The Manufacturers Name, Proper Names, Trademarks, Patents Or The Origin Of Materials Or Devices Used To Perform Construction Works That Are The Subject Of The Contract Are Indicated, This Should Be Treated As An Exemplary Solution Specifying The Standards, Appearance And Technical Requirements - And The Ordering Party, In Accordance With Art. 29(3) Of The Public Procurement Law Allows For The Use Of Equivalent Materials And Devices. The Ordering Party Allows Any Market Equivalents With Parameters Equal Or Better Than Those Indicated. This Means That The Materials And Devices Intended For Use By The Contractor At The Stage Of Execution Of The Works Should Meet The Parameters Specified In The Tender Documentation Of The Procedure And Should Not Be Worse Than Its Assumptions (Equal Or Better), I.E. They Must Be At Least: The Same Strength, The Same Durability, The Same Level Of Aesthetics Of The Device, The Technical Parameters Of Materials And Devices If Specified In The Design Documentation, They Must Be Compatible With The Existing And Designed Infrastructure, Fulfill The Same Functions, Meet The Requirements Of Construction Safety, Occupational Health And Safety And Fire Protection, Have Appropriate Documents Allowing For Use In Construction, Certificates And Technical Approvals. The Burden Of Proving That The Material (Product) Is Equivalent To The Requirement Specified By The Ordering Party Rests With The Contractor With Whom The Contract Was Signed. In Such A Case, The Contractor Must Submit Appropriate Documents Describing Technical Parameters, Legally Required Certificates And Other Documents Authorizing The Given Material (Product) For Use And Making It Possible To Clearly State That They Are Actually Equivalent.
