Description Of The Subject Of The Order: 1. The Subject Of The Order Is The Purchase Of A Brand New Backhoe Loader That Meets The Stage V Exhaust Emission Standard In Accordance With The Requirements And On The Terms Indicated In The Detailed Description Of The Subject Of The Order Constituting Annex No. 3 To The Swz, And Its Delivery To The Place Indicated By The Ordering Party In The Kamień Commune. The Subject Of The Order Is Co-Financed By The Civil Protection And Civil Defense Program For 2025-2026.2. The Delivered Backhoe Loader Must: 1) Be Brand New, Undamaged, Free From Physical Defects (Design, Material, Workmanship And Technical), Complete, Manufactured No Earlier Than 2026, Fully Technically Operational, Suitable For Proper Operation In Accordance With The Functional Scope And Intended Use; 2) Constitute The Exclusive Property Of The Contractor And Be Free From The Rights And Claims Of Third Parties; 3) Have Valid Certificates, Approvals, Certificates, In Accordance With Applicable Standards And Legal Regulations.4. Together With The Offer, The Contractor Submits A Completed Table - Annex No. 3 To The Swz, Which Constitutes Part Of The Offer And Is Not Subject To Supplementation In Accordance With The Public Procurement Law. 5. The Subject Of The Order Also Includes Training Of The Ordering Partys Representatives In Vehicle Operation. 6. All Requirements Specified In The Documents Indicated Above Are Minimum Requirements, And Their Fulfillment Is Obligatory. Failure To Meet The Above-Mentioned Minimum Requirements Will Result In Rejection Of The Offer As Inconsistent With The Terms Of The Contract Pursuant To Art. 226 Section 1 Point 5 Of The Pzp.7 Act. A Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Its Description Or Standards. In The Case Of Describing The Subject Of The Contract By Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, The Ordering Party Allows Solutions Equivalent To Those Described, And Such Reference Is Accompanied By The Words Or Equivalent.8. If The Description Of The Subject Of The Order Indicates The Origin (Brand, Trademark, Manufacturer, Supplier) Of Materials Or Standards, Approvals, Specifications And Systems Referred To In Art. 99 Section 5 Of The Public Procurement Law, The Ordering Party Allows The Offer Of Materials Or Equivalent Solutions Provided That They Guarantee The Correct Delivery And Ensure That Technical Parameters Are Not Worse Than Those Assumed.9. The Ordering Party Reserves The Right To Cancel The Tender Procedure If The Public Funds It Intended To Use To Finance All Or Part Of The Order Are Not Awarded To It.
