1. The Subject Of The Order Is The Comprehensive Provision Of Water Rescue Services And First Aid Services At The Indoor Swimming Pool Of The University Of Economics In Katowice Located At Ul. Bogucicka 3B (Building C), 40-226 Katowice, In Accordance With The Applicable Principles And Conditions Specified In Legal Provisions, In Particular The Act Of August 18, 2011 On The Safety Of Persons Staying In Water Areas (Consolidated Text: Journal Of Laws Of 2023, Item 714).2. The Provision Of Water Rescue Services And First Aid Services Will Be Carried Out In A Swimming Pool With A Length Of 25 M And A Depth Of 1.15 M To 1.75 M, With 5 Swimming Lanes. In Order To Ensure Safety In The Ordering Partys Indoor Swimming Pool, The Contractor Is Obliged To Assign At Least Two Water Rescuers To Provide The Service At The Same Time.3. The Description Of The Subject Of The Order And The Description Of The Method Of Performing The Order As Well As The Contractors Obligations Are Specified In:3.1. The Draft Provisions Of The Contract Constituting Annex No. 1 To Swz.3.2. Detailed Description Of The Subject Of The Order Constituting Annex No. 2 To The Swz. 4. Employment Clause:4.1. The Ordering Party Requires Employment By A Contractor Or Subcontractor Under An Employment Contract In Accordance With Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Consolidated Text: Journal Of Laws Of 2025, Item 277), Persons Performing Activities Related To The Implementation Of The Subject Of The Contract Throughout The Duration Of The Public Procurement Contract. This Requirement Applies To All Persons Who Will Perform Activities Directly Related To The Performance Of The Service That Is The Subject Of This Order, I.E. Water Rescuers. Man-Hours Earned In The Course Of Providing The Service Cannot Be Provided By Persons Employed By The Contractor Or Subcontractor Under A Contract For Specific Work, A Mandate Contract Or Any Relationship That Is Not An Employment Relationship Within The Meaning Of The Provisions Of The Labor Code.
