1. The Subject Of The Order Is The Provision Of A Service Called Rental Of The Kitchen (Catering Facilities) In The Municipal Cultural Center In Zaleszany And Provision Of Catering Services For Kindergartens And Schools Run By The Zaleszany Municipality In The School Year 2026/2027, 2027/2028 And 2028/2029.2. When Starting The Execution Of This Order, The Contractor Is Obliged To Perform The Order In The Leased Kitchen (Catering Facilities) In The Municipal Cultural Center In Zaleszany And Using The Installed Equipment. The List Of Kitchen Rooms And Equipment Is Attached As Annex 9 To The Swz. 3. In Connection With The Lease Of The Kitchen (Catering Facilities), The Municipal Cultural Center In Zaleszany Will Collect A Lease Fee Of Pln 4,000.00 Net/Month Plus The Applicable Vat. The Draft Lease Agreement Constitutes Annex No. 10 To Swz.4. Before Starting The Execution Of The Order In The Leased Kitchen Premises (Catering Facilities) At The Municipal Cultural Center In Zaleszany, The Contractor Is Obliged To Submit An Application To The Relevant State District Sanitary Inspector And Obtain A Sanitary Decision (Plant Approval) Or An Entry In The Register For The Catering Kitchen. For This Purpose, The Ordering Party Will Hand Over The Facility To The Contractor In A Protocol Immediately After Signing The Lease Agreement And The Public Procurement Agreement.5. The Legal And Administrative Status Of The Kitchen And The Conditions For Commencing The Execution Of The Order: 1) The Kitchen (Catering Facilities) Located In The Municipal Cultural Center In Zaleszany, Which Is The Subject Of The Lease, Is A Newly Established Catering Facility And Before The Date Of Initiation Of These Proceedings Was Not Used To Conduct Business Involving The Production Of Meals; 2) As Of The Date Of Initiation Of The Proceedings, The Kitchen Does Not Have A Decision Of The Competent State District Sanitary Inspector Approving The Plant, Nor An Entry In The Register Of Establishments, Regarding Referred To In The Provisions Of The Act Of August 25, 2006 On Food And Nutrition Safety;3) In Accordance With Applicable Law, The Obligation To Notify The Establishment And Obtain The Required Administrative Decisions Before Starting The Catering Business Rests With The Entity Conducting The Business, I.E. The Contractor Executing The Order;4) The Ordering Party Will Hand Over The Kitchen To The Contractor In An Acceptance Protocol Immediately After Concluding The Public Procurement Contract And The Lease Agreement, Within A Time Limit Enabling The Contractor To Registering The Plant, Carrying Out The Necessary Organizational Activities And Obtaining The Required Decisions Of The Competent State District Sanitary Inspector Before Starting The Provision Of Services;5) The Condition For Starting To Prepare Meals In The Leased Kitchen Is That The Contractor Must Obtain The Required Decision Of The Competent State District Sanitary Inspector Approving The Plant Or Make An Effective Ent
