Cargo Handling And Storage Services – Allocation Of Bulk Cargo Area At The Port Of Bohmte. 1. The Settlement Property Will Only Be Allocated Within The Framework Of A Concession Agreement For Bulk Goods Handling Area With A Binding Determination Of The Intended Use Of The Handling Area For Bulk Goods (In Particular: Recycling Material And Building Materials). Acquisition Of The Settlement Property Is Excluded. With This Concession Agreement For Bulk Goods Handling Area, The (Then) Operator Is Obliged To A) Carry Out The Construction Of Any Superstructure Still Required For The Operation And B) To Operate The Settlement Property As A Handling Area For Bulk Goods In A Non-Discriminatory Manner. 2. Hwl Has Purchased Port Handling Equipment (Excavators And A Skid Steer Loader; Hereinafter: Equipment) For The Operation Of The Port. The Operator Will Be Obliged To Rent The Equipment (Without Providing Staff) Under Conditions That Are Still To Be Negotiated (Pro Rata If Necessary) And To Use The Equipment To Operate The Settlement Property. 3. A Minimum Rental Fee To Be Paid By The Operator As Well As Handling Guarantees Are Required. Bidders May Offer Higher Amounts Than The Minimum Requirements In Their Offers. This Information Will Be Relevant To The Negotiation Process. The Rent And The Handling Guarantee Are Contractually Secured In Value. 4. The Operator Must Offer Its Transshipment Services And Other Services Offered In Connection With The Operation Of The Settlement Property To All Interested Companies Under Appropriate, Non-Discriminatory Conditions. The Operator Must Build And Operate The Settlement Property As A Public Transshipment Facility In His Own Name And On His Own Account. The Operator Bears The Corresponding Operational Risk. 5. Hwl Reserves The Right To Give Bidders The Opportunity To Include The Operation Of The Shore Loading Road, Which Is To Be Operated On A Non-Discriminatory Basis As Part Of The Public Port, As Part Of Their Offer. However, It Is Clarified That Hwl Is Not Obliged To Make Use Of This Reservation Even If The Bidders Interest Is Made Clear. As Part Of The Negotiations - Assuming There Is Appropriate Interest And Suitability From The Bidding Group(S) - In Addition To The Concession Agreement For Bulk Cargo Handling Area, A Works Agreement Or A Concession Agreement For Uferladestrasse Can Also Be Negotiated. The Uferladestrasse Concession Agreement Will Contain, Among Other Things, The Right And Obligation Of The Operator To Offer Transshipment Services Using The Uferladestrasse, Including Vehicle Scales, To Any Interested User On Reasonable Terms And Conditions, Without Discrimination, For The Duration Of The Corresponding Agreement. There Are Stationary Transshipment Facilities Used By Residents Of The Port On The Uferladestrasse, Or Such Transshipment Facilities Are Being Planned. The Operator Has The Existence Of These (Existing And Future) Systems And The Operation Of These By The Respective Settlers, E.G
