Tenders Are Invited For Maintenance Of County Roads With Bitumen Surfaces in Poland

Work Detail

1. The Subject Of The Order Is The Performance Of Road Works In The Scope Of Maintaining Roads With Bitumen Surfaces, Described In Detail In The Items Of The Offer Cost Estimate, Constituting Annex No. 1 To The Swz, Commissioned To The Contractor In Partial Orders According To The Current Needs Of The Ordering Party. In Partial Orders, The Ordering Party Will Specify The Scope Of Works, The Place Of Performance Of These Works, Unit Prices Of Works, The Total Net And Gross Value Of Works And The Deadline For Completing The Partial Order. The Deadline For Completing The Partial Order Will Be Determined In Consultation With The Contractor. If It Is Impossible To Establish A Common Position, This Deadline Will Be 14 Business Days And Will Be Counted From The Date Of Handing Over The Construction Site. For The Execution Of A Partial Order, The Contractor Will Be Entitled To Remuneration, In Accordance With The Provisions Of § 6 Of The Essential Provisions Of The Contract. The Estimated Quantities Of Works Provided In The Offer Cost Estimate Form And The Gross Value Provided By The Contractor For The Execution Of The Entire Order Are Used Only To Compare Offers In Order To Select The Contractor Based On The Most Advantageous Offer. The Contractors Actual Remuneration Will Be Calculated In Accordance With § 6 Of The Material Provisions Of The Contract Based On The Unit Prices Provided By The Contractor In The Offer Cost Estimate. The Ordering Party Reserves The Right To Change The Quantities (Proportions) Of Individual Works Specified In The Offer Cost Estimate. This Change Will Consist In The Possibility Of Increasing Or Reducing The Number Of Works Ordered During The Execution Of The Contract, Within The Value Of The Maximum Amount Specified In The Contract That May Be Spent On The Implementation Of The Contract In Question. The Above Changes Cannot Cause Changes In Unit Prices Or Exceed The Contract Value (Gross). The Ordering Party Also Reserves The Right To Limit The Scope Of The Subject Matter Of The Contract To 60% Of The Gross Contract Value. Failure By The Ordering Party To Use 40% Of The Gross Contract Value Cannot Constitute The Basis For Claims For Damages From The Contractor For Failure To Complete The Order.2. The Ordering Partys Requirements Regarding The Employment Of Persons Under An Employment Contract By The Contractor Or Subcontractor.1) The Ordering Party, Pursuant To Art. 95 Section 1 Of The Public Procurement Law Requires The Contractor Or Subcontractor To Employ, Under An Employment Contract, Persons Performing Activities Related To The Execution Of The Order, The Performance Of Which Consists In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974, Labor Code (Journal Of Laws Of 2025, Item 277, As Amended). This Requirement Applies To Persons Who Perform Activities Directly Related To The Performance Of The Scope Of The Order, I.E. Manual Workers, Drivers Of Means Of Transport, Machinery And Equipme
