Photocopiers – Lease Of 27 Photocopiers For The District Prosecutors Office In Lublin And Its Subordinate District Prosecutors Offices. 4.1. The Subject Of The Order Is The Lease Of 27 Photocopiers For The District Prosecutors Office In Lublin And Its Subordinate District Prosecutors Offices. 4.2. The Order Will Consist In Ensuring Full, Constant Operation Of The Leased Photocopiers During The Term Of The Contract. Costs Of Depreciation Of Leased Devices, Consumables (Except Photocopier Paper), Costs Of Inspections And Repairs Not Caused By The Ordering Partys Fault, Costs Of Spare Parts For Leased Devices, Costs Referred To In § 3 Section 3 And In § 4 Section 8 And 13 Of Annex No. 1 To The Swz, The Cost Of Delivering And Collecting Photocopiers, The Costs Of Service Travel And Training Of Indicated Employees Of The Ordering Party Are Borne By The Contractor. Note: 1. The Ordering Party Provides For The Right Of Option For This Procedure, Under Which It Will Be Entitled To Order The Contractor To Perform The Subject Of The Order To A Wider Extent, Consisting In Leasing A Maximum Of 5 Additional Devices Referred To In § 3 Section. 2 Of Annex No. 1 To The Swz (Black And White Photocopiers). 2. Exercising The Option Right Is A Right And Not An Obligation Of The Ordering Party. Failure To Exercise This Right Does Not Result In Any Claims Of The Contractor Against The Ordering Party. 3. The Option Right Will Be Exercised When At Least One Of The Following Conditions Occurs: A) The Basic Scope Of The Order Is Deemed Inadequate To The Needs Of The Ordering Party, B) Increasing The Number Of Devices Will Have A Positive Impact On The Efficiency Of The Organizational Unit, C) There Will Be An Organizational Change Justifying The Increase In The Number Of Devices. 4. The Option Right Will Be Exercised On The Basis Of The Ordering Partys Declaration, Which Will Specify The Scope Of The Option Right Being Exercised And The Entity To Which The Device Will Be Delivered. 5. The Ordering Partys Right To Exercise The Option Right Expires If It Does Not Submit The Declaration Referred To In Point 4) No Later Than 3 Months Before The End Of The Contract. 6. The Ordering Party Retains The Right To Exercise The Option Right Once Or More Times Until The Full Scope Of The Option Right Is Exhausted. 7. The Lease Price And The Price For One Page Will Be Maintained For The Option Right At The Level Adopted By The Contractor For The Basic Scope. 8. The Rules For Exercising The Option Right By The Ordering Party Are Set Out In Annex No. 1 And 2 To The Swz.
