Tenders Are Invited For Successive Provision Of Hardware Services In The Ustka Commune in Poland

Part I: Successive Provision Of Equipment Services In The Ustka Commune: (Area I - Villages: Przegląd, Wytowno, Machowinko, Machowino, Objazda, Gąbino, Dębina, Rowy) With The Following Equipment: A) Backhoe Loader With A Bucket Capacity Of At Least 0.30 - 0.9 M³, B) Tipper Truck With A Capacity Of At Least 8 T, C) Rotary Crawler Excavator With A Bucket Capacity Of At Least 0.80 M³. Scope Of Equipment Work: Earthworks, Transport. Time Counted As Work: A) Is The Time Of Loading, Unloading And Transporting Materials, Excavating, Planting And Leveling The Area, Mowing The Area, B) The Time Of Equipment Failure And Inoperability, As Well As The Time Of Travel To And From Work (Place Of Service). C) Will Be Deducted From The Work Time. Estimated Amount Of Equipment Work: Part I: Backhoe Loader: 700 H, Truck: 200 H, Excavator 100 H. The Number Of Hours Of Equipment Work Are Estimated Amounts, Determined On The Basis Of The Current State Of Knowledge Of The Ordering Party Regarding The Needs In The Field Of Equipment Work. Settlement With The Contractor Will Be Based On The Services Actually Ordered And Performed. The Contractors Obligations Include: 1) Ensuring Constant Telephone Communication With The Ordering Partys Employee - A Representative Of The Municipal Economy Department Of The Ustka Commune Office, 2) Starting To Perform The Service Immediately, But No Later Than Within 24 Hours, According To The Ordering Partys Needs Reported By An Employee Of The Municipal Economy Department Of The Ustka Commune Office In Writing Or By Telephone. Employment Requirements Based On An Employment Relationship, In Circumstances Referred To In Art. 95 And In The Scope Of Employment Of Persons Referred To In Art. 96 Section 2 Point 2, If The Ordering Party Provides For Such Requirements: The Ordering Party Requires The Contractor And Subcontractors To Employ Persons Under An Employment Contract To Provide Services In The Scope Of The Implementation Of The Subject Of The Order, I.E. Provision Of Equipment Services. These Activities Fall Within The Scope Of Art. 22 § 1 Of The Labor Code, Which Reads: By Entering Into An Employment Relationship, The Employee Undertakes To Perform Work Of A Specific Type For The Employer And Under His Direction And At The Place And Time Designated By The Employer, And The Employer - To Employ The Employee For Remuneration. The Method Of Documenting The Employment Of People, The Ordering Partys Rights To Control The Contractors Compliance With The Above-Mentioned Requirements And Sanctions For Failure To Meet These Requirements Are Specified In Annex 8 To The Swz - Contract Template. The Ordering Party Does Not Reserve The Obligation For The Contractor To Personally Perform Key Tasks Related To The Subject Of The Order (Article 121 In Connection With Article 266 Of The Public Procurement Law).
