1. The Subject Of The Order Is The Construction Of A Shelter At The Building Of The Commune Office In Tuchomie. The Scope Of The Order Includes The Preparation Of Design Documentation And The Execution Of Construction Works Related To The Construction Of The Shelter, Together With The Related Reconstruction Of The Building Of The Commune Office In Tuchomie. The Scope Of The Order Includes Implementation In The Design And Build Formula In Accordance With The Description Included In The Functional And Utility Program And Includes The Design And Execution Of Construction Works In The Above-Mentioned Scope. The Detailed Scope Of Works Is Described In The Functional And Utility Program Of The Pfu (Annex To Swz No. 4), However, The Ordering Party Allows Solutions Equivalent To Those Described In The Above-Mentioned Documentation. Before Commencing Works In Built-Up Areas, The Contractor Will Notify The Owners Of Properties And Buildings, Including Adjacent Ones (If Applicable). Before Commencing The Works, The Contractor Will Also Notify The Interested Institutions And Owners Of Underground Utilities About The Commencement Of Construction (If Applicable). When Carrying Out Earthworks In Very Close Proximity To Buildings, Special Caution Should Be Exercised And Construction Law Regulations Must Be Strictly Observed. The Contractor Undertakes To Perform The Subject Of The Contract In Accordance With The Documentation, Principles Of Technical Knowledge And Construction Practice, Applicable Regulations And Polish Standards, On The Terms Specified In The Contract And Swz. The Materials Adopted In The Functional And Utility Program Guarantee The Achievement Of The Intended Effect. If References To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Are Used In The Documentation Describing The Subject Of The Order, The Ordering Party Allows Solutions Equivalent To Those Described. When Analyzing The Documentation, The Contractor Should Assume That Each Reference Used In The Documentation Is Accompanied By The Word Or Equivalent. If The Documentation Describing The Subject Of The Contract Uses Trademarks, Patents Or The Origin Of Products/Source/Particular Process That Could Characterize The Products Or Services Provided By A Specific Contractor, It Means That They Are Provided As Examples And Specify Only The Minimum Expected Quality Parameters And The Required Standard. The Contractor May Use Equivalent Materials Or Devices, But With Similar Or Better Technical And Quality Parameters, The Use Of Which Will In No Way Adversely Affect The Proper Functioning Of The Solutions Adopted In The Documentation. The Contractor Who Uses Equivalent Devices Or Materials Will Be Obliged To Demonstrate During The Execution Of The Order That The Devices And Materials Used By Him Meet The Requirements Specified By The Ordering Party.
