The Material Scope Of The Order Includes Execution In A Given Area With Due Care, Taking Into Account The Professional Nature Of The Services Provided, In A Manner Consistent With The Principles Of Horticultural Art, The Management System For Public Green Areas For The City Of Tychy Posted On The Website Https://Bip.Umtychy.Pl/Zarzaczenia-Ppowiedza-Miasta/73542 And The Nature Protection Act, The Plant Protection Act, Environmental Protection Law, In Accordance With Applicable Standards, Ensuring The Achievement Of An Appropriate Aesthetic Effect For Activities Covered By The Subject Of The Order, Settled On A Lump Sum Or As-Built Basis (In Accordance With The Offer Cost Estimate - Annex No. 1A To The Swz And The List Of Areas - Annex No. 4A To The Swz - List Of Sopz Areas). The Scope Of The Subject Of The Order Includes Works Settled On: A) Lump-Sum Basis: Filling Holes With Soil; B) As-Built: Mowing Lawns; Mowing Brush; Mowing Flower Meadows; Raking And Removing Leaves; Maintenance And Care Of Older Bushes (Single And In Groups); Removal Of Bushes; Maintenance And Care Of Hedges. A Detailed Description Of The Subject Of The Order Is Set Out In Annex No. 4 To Swz.1. If Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes Products Or Services Provided By A Specific Contractor Are Indicated In The Order Documents, The Ordering Party Allows The Use Of Materials Equivalent To Those Described.2. If The Description Of The Subject Of The Contract Includes References To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Act, The Ordering Party Allows Solutions Equivalent To Those Described.3. A Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Attaches To The Offer Documents Confirming The Equivalence Of The Offered Solutions. The Burden Of Proving Equivalence Rests With The Contractor.
