Tenders Are Invited For Successful Delivery Of Laboratory Glassware in Poland

1) The Subject Of The Order Are Successive (In Batches Depending On Needs, Based On Orders) Deliveries Of Laboratory Glassware, Hereinafter Referred To As Materials Or Products. The Materials Should Be Brand New And Come From Current Production (Year Of Production 2025 Or Newer).2) The Scope Of The Order Includes: Delivery Of Materials Along With Transport And Unloading At The Place Indicated By The Ordering Party.3) A Detailed Description Of The Subject Of The Order Is Attached As Annex No. 2 To The Swz.4) The Ordering Party Reserves That The Quantities Of Ordered Products Given In Annex No. 2 To The Swz Are Not Binding But Estimated Quantities. The Ordering Party Reserves The Right Not To Use The Entire Product Range Of The Contract In The Event Of Changes In The Ordering Partys Needs Which It Cannot Predict At The Stage Of Preparing The Procedure For Awarding This Contract. In Such A Case, The Ordering Party Will Pay The Contractor Remuneration Based On The Actual, Final Quantity Of Materials Ordered, Calculated On The Basis Of Unit Prices, In Accordance With The Contractors Offer. Therefore, Due To The Possibility Of Limiting The Scope Of The Order, In Accordance With Art. 433 Point 4 Of The Public Procurement Law, The Ordering Party Guarantees The Implementation Of The Subject Of The Agreement Up To The Amount Constituting 75% Of The Contract Value. In Other Respects, The Contractor Is Not Entitled To Any Claims For Failure To Use The Full Value Of The Agreement. 5) The Ordering Party Reserves The Right To Implement A Different Purchasing Structure Than That Provided For In The Tor. The Contractor Will Not Be Entitled To Any Claim In The Above Cases (Due To A Reduction In The Ordered Quantities/Range, And Thus Failure To Use The Full Amount Of The Contract), Subject To The Provisions Of Point (A). B) Above. If The Quantities Specified In The Offer Are Exceeded, The Product Will Be Delivered On The Terms And Conditions Contained In The Offer, Provided That The Value Of The Contract Cannot Be Exceeded. 6) Pursuant To The Concluded Contract, The Ordering Party Will Also Purchase Glass Other Than That Specified In Annex No. 2 To The Swz. In Such A Case, The Basis For Determining The Net Price Of Laboratory Glass Will Be The Current Net Prices Of Materials Available In The Contractors Catalog, Specified In Pln, Including The Appropriate Vat Rate, Taking Into Account The Discount Offered In The Offer, Provided That The Value Of The Contract Cannot Be Exceeded. The Contractor Will Immediately Inform The Ordering Party About Any Changes To The Catalog To The Indicated E-Mail Address.7) The Contractor Will Implement The Subject Of The Contract For A Period Of 12 Months From The Date Of Receipt Of The First Order Under The Concluded Contract Or Until The Value Of The Contract Is Exhausted If It Is Exhausted Before The Expiry Of 12 Months;8) The Ordering Party Informs That The First Orders Will Be Sent No Earlier Than April 23, 2026.9) The Subject Of T
