1. The Subject Of The Order Is The Renovation Of A Building Managed By Bytomskie Mieszkanie, Located At Ul. Witczaka 37 In Bytom.2. The Scope Of Construction And Installation Works Is Diverse And Includes General Construction Works, Plastering And Painting, Carpentry And Installation Works.3. A Detailed Description Of The Subject Of The Order, Conditions Of Execution And Acceptance Of The Works Are Attached As Annex No. 1.1.A To The Swz - Specification For The Execution And Acceptance Of Works.4. The Ordering Party Attaches The Bills Of Quantities (Appendix No. 1.1 To The Swz) As Non-Binding Material. The Attached Bills Of Quantities Are Indicative And Should Be Treated As Supporting Material For A Quick And General Understanding Of The Material Scope And Size Of The Project. The Quantity And Description Of Individual Items Of The Bill Of Quantities Should Not Be Treated As Final And Defining.5. The Subject Of The Order Should Also Be Carried Out In Accordance With The Extract From The Technical Opinion Of The Building (Appendix No. 1.1.B To The Swz) And In Accordance With The Chimney Sweepers Opinions (Appendix No. 1.1.C To The Swz).6. The Terms Of Execution Of The Order Are Included In The Draft Provisions Of The Contract Constituting Annex No. 2 To Swz.7. The Ordering Party Attaches Photographic Documentation For Illustration Purposes, Which Can Be Found At: Https://Drive.Google.Com/File/D/1M0hq0ga54qpedgakf0gi83lj5bq1vtia/View?Usp=Sharing8. The Contractor Is Obliged To Provide The Ordering Party With A 60-Month Warranty For The Completed Subject Of The Order, Counted From The Date Of Final Acceptance Of The Construction Works Being The Subject Of The Order.9. The Ordering Party Did Not Divide The Procedure Into Parts, Which Is Justified By Technical And Organizational Reasons - The Subject Of The Order Is Performed In One Location And Constitutes A Functional Whole. Dividing The Procedure Into Parts Would Result In The Need To Coordinate The Activities Of Various Contractors Implementing Individual Parts Of The Contract On A Small Area. This Would Create A Risk Of Avoiding The Liability Of The Contractors Due To The Difficulty In Clearly Determining The Causes Of Errors In The Works Performed - Which Seems To Be Possible For Several Contractors Whose Total Effect Of Work Determines The Correct And Safe Performance Of Construction Works. In Relation To The Above, Further Division Of The Order Into Parts Is Not Justified, As It May Lead To A Total Increase In Costs Related To The Works Performed By The Contractors. Moreover, The Lack Of Dividing The Contract Into Parts While Conducting The Procedure In One Of The Competitive Modes Provided For In The Public Procurement Act - The Basic Mode - Does Not Restrict Competition And Ensures Equal Access For Entities From The Micro, Small And Medium-Sized Enterprises Sector. At The Same Time, The Ordering Party Indicates That This Procedure Has Been Included In The Procedure Plan For 2026 In Plan Item 1
