1. The Subject Of The Order Is The Renovation Of The Municipal Road Ul. Market Square In Klimontów On A Section Of 0.187 Km, I.E. Renovation Of The Road Surface, Width 5.0-6.3 M, By Replacing The Existing Surface Made Of Basalt Cubes On A Concrete Ballast, Dismantling And Constructing A New Surface From Granite Cubes On Strips On A Concrete Ballast, And Performing All Works Resulting From The Specification Of The Terms Of Order, Design Documentation - An Annex To The Notification Of The Intention To Perform Construction Works, Bill Of Quantities Works And Technical Specifications For The Execution And Acceptance Of Works. All Documents Describing The Subject Of The Contract Should Be Treated As Complementary And Clarifying In The Sense That If Any Ambiguity Or Ambiguity Is Found, The Contractor Cannot Limit Either The Scope Of His Obligation Or The Scope Of Due Diligence In The Performance Of His Obligations Under The Public Procurement Contract. Regardless Of The Degree Of Accuracy And Precision Of The Documents Received From The Investor, Defining The Order To Be Performed, The Contractor Is Obliged To Obtain A Good Final Result. All Trademarks, Patents Or Indicated Origins, Product And Company Names Used In The Design Documentation And In Other Documents Are Intended Solely To Indicate The Minimum Technical And Quality Parameters Expected By The Ordering Party. The Ordering Party Allows The Offer Of Materials Or Equivalent Solutions Provided That They Guarantee The Implementation Of The Works In Accordance With The Technical Documentation And Ensure That Technical Parameters Are Not Worse Than Those Assumed In The Above-Mentioned Documentation. The Ordering Party Considers The Minimum Requirements To Be The Parameters Specified In The Applicable Standards In The Detailed Technical Specifications. The Subject Of The Contract May Be Subject To Modification If, In The Course Of Performing The Works, It Turns Out That The Tender Documentation Contains Defects Whose Existence Makes It Impossible To Perform The Works In Accordance With The Applicable Regulations And Standards. In Such A Case, The Parties Will Determine The Scope Of Discontinued And Additional Works And The Scope Of Replacement Works, And The Modified Method Of Performance By The Contractor Will Be Specified In An Annex To The Contract. 2. The Price Of The Task Should Also Include The Costs Necessary To Complete The Order, I.E.: • Costs Of Introducing Temporary Traffic Organization, Arrangement, Security And Tidying Up Of The Construction Site After The Order Is Completed, • Costs Of Dismantling, Reconstruction And Cleaning Works, • Costs Of Laboratory Tests, Tests, Acceptances • Costs Of Entering The Area Outside The Road Right-Of-Way Of A Municipal Road
