The Sixth Law Amending The Road Traffic Act And Other Road Traffic Regulations, Which Came Into Force On August 22, 2024, Introduced A Legal Thc Limit Of 3.5 Ng/Ml In Blood Serum In Road Traffic (Section 24A Stvg). In Addition, A Thc Limit Of 1.0 Ng/Ml In The Blood Serum Applies To Novice Drivers And Young Drivers Before The Age Of 21 (§ 24C Stvg). Since In Individual Cases It Cannot Be Ruled Out That With Frequent Consumption The Thc Concentration Will Be Above The Effect Limit Of 3.5 Ng/Ml Thc In The Blood Serum, Despite An Adequate Separation Between Consumption And Driving, The Expert Working Group, On Whose Recommendation The New Thc Limit Is Based, Has Considered The Use Of Saliva Tests With High Sensitivity As A Pre-Screening To Prove Current Consumption Necessary For Reasons Of Practicability And To Avoid Recording Long-Ago Consumption. The Aim Of This Research Project Is To Determine Which Measurement-Specific Criteria Should Be Specified In Saliva Pre-Tests That Are Used Within The Framework Of Section 24A Stvg And Section 24C Stvg In Order To Correlate As Highly As Possible With The Results Of The Confirmatory Analyzes In Blood Serum. This Definition Should Also Take Into Account That Acute Cannabis Consumption Is, If Possible, Displayed As Positive For As Long As The Duration Of The Traffic Safety-Relevant Impairment Of Occasional Users, As Shown In The Literature Analysis, Lasts. Furthermore, Newer Methods Such As Saliva As A Matrix For A Confirmatory Analysis And The Possibilities Of Using Capillary Blood In Preliminary Tests Will Be Examined.
