The Subject Of The Order Is: Partial Renovation Of Bituminous Roadways In 2026 In The Stęszew Commune Using The Contractors Material. Location: Stęszew Commune, Poznań County, Greater Poland Voivodeship. Scope Of Work In Accordance With The Attached Bill Of Quantities. Note! The Scope Of Work Given In The Bill Of Quantities Is The Maximum Amount. The Ordering Party Reserves The Right To Perform A Smaller Scope Of Works According To Its Needs. If The Entire Amount Specified In The Contract Is Not Used Due To A Reduction In Demand, The Contractor Will Receive Remuneration For The Actual Amount Of Work Performed, Determined On The Basis Of The Unit Rate And The Actual Amount Of Work Performed. Other Works In Accordance With The Bill Of Quantities And Tidying Up The Area After Completed Work. The Contractor Will Perform All Necessary Work For The Proper Execution Of The Subject Of The Order. The Works Should Be Performed In Accordance With The Tender Documentation And In Consultation With The Ordering Party. The Works Will Be Performed On The Basis Of A Written Order Placed By An Employee Of The Municipal Office Of The Stęszew Commune, Which Will Specify The Scope And Deadline For Execution. The Contractor Is Obliged To Respond To Each Notification From The Ordering Party, Regardless Of The Number/Size Of The Ordered Works. Lack Of Response And Delay In Response To The Notification In Question Will Result In Contractual Penalties Described In § 8 Of This Agreement. Work Execution Technology: Work Related To The Implementation Of The Investment Should Be Carried Out In Accordance With Applicable Standards, Construction Law Provisions, Legal Provisions Regarding Technical Requirements, Environmental Protection, In Accordance With Occupational Health And Safety Rules And Technical Knowledge. The Contractor, On His Own Responsibility And At His Own Expense, Should Take All Preventive Measures Required By Sound Construction Practice And Current Circumstances To Secure The Rights Of Property Owners Adjacent To The Construction Site/Works And Avoid Causing Any Disturbances Or Damage There. The Contractor Is Liable To Third Parties For Any Damage Resulting From The Implementation Of The Subject Of The Contract. The Surrounding Area As Well As Pedestrian And Vehicular Traffic Should Be Permanently Protected Against The Impact Of The Works. Social Clause: The Ordering Party Requires That Persons Performing Services And Construction Works Specified In The Tender Documentation And Equipment Operators Be Employed Under An Employment Contract By The Contractor Or Subcontractor, With The Exception Of Persons Whose Duties Are Not Consist In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws 2022.1510, Consolidated Text Of 2022/07/19), Which May Apply, Among Others, To Construction Managers And Managers Of Industrial Works.
