The Subject Of The Order Is The Supply Of Medical Gases With The Lease Of A Cylinder And A Tank For Liquid Medical Oxygen In Accordance With The Description And Requirements Contained In Annex No. 2, I.E. In The Assortment And Price Form To The Terms Of Reference.2. Medical Gases Such As: Medical Oxygen, Nitrous Oxide And A Medical Mixture Of Nitrous Oxide And Oxygen For Anesthesia, Medical Carbon Dioxide For Laparoscopy And Medical Compressed Air Should Have Valid Permits Allowing For Marketing And Use In The Republic Of Poland.3. Medical Carbon Dioxide For Cryotherapy And Disposable Mouthpieces For A Medical Mixture Of Nitrous Oxide And Oxygen Should Have Valid Documents Confirming That The Products Offered By The Contractor Are Medical Devices And Are Approved For Trading And Use In Accordance With The Act Of April 7, 2022 On Medical Devices (Journal Of Laws 2024.1620, I.E. Of 2024/11/05). The Offered Assortment Should Be Compliant With European Union Directives.4. In These Proceedings, The Ordering Party Refrained From Dividing The Order Into Parts Due To Technical And Organizational Reasons. The Delivery In Question Together With The Lease Is A Comprehensive Order And Only A Fully Completed Order Guarantees The Ordering Party To Achieve The Desired Effect And Meet The Requirements Under Applicable Law, Because The Description Of The Subject Of The Order Concerns The Supply Of Medical Gases With Specialized Transport And The Lease (Medical Cylinders, Tank For Liquid Medical Oxygen). It Is Not Possible To Divide This Order Into Parts. 5. All The Above-Mentioned Elements Described In The Swz Constitute The Subject Of The Order And, If Implemented In Their Entirety, Will Ensure Proper Execution Of The Order. It Should Also Be Noted That Not Dividing The Contract Into Lots Will Not Infringe Fair Competition Because This Contract Cannot Be Divided Into Lots.
