The Subject Of The Order Is An Icp-Ms Spectrometer For Analyzes Combined With Hplc And Gc With The Possibility Of Connecting An Ion Chromatograph And A Laser Evaporation System (Ablation) As Part Of The Project Entitled Public Security Technology Center, Contract Number Feds.01.01-Iz.00-0003/24, Implemented By The Wrocław University Of Science And Technology. All Costs Related To The Performance Of The Subject Of The Contract, Including Delivery, Insurance And Risk, Are Borne By The Contractor. The Ordering Party Declares That The Subject Of This Contract Was Co-Financed By The European Funds For Lower Silesia 2021-2027, Priority 1 European Funds For An Entrepreneurial Lower Silesia. The Detailed Scope Of Performance Of The Subject Of The Contract, Which Is The Draft Provisions Of The Public Procurement Contract, Is Included In The Contract Template Constituting Annex No. 2 To The Swz. 5. The Delivered Item Must Be Brand New, Not Exhibited At Exhibitions, Complete And Technically Functional. The Statement Brand New Should Be Understood As The Subject Of The Order In Its Original Packaging, Unused Before The Date Of Delivery, Excluding Use Necessary To Test Its Correct Operation After Production. The Subject Of The Order Must Be Free From Any Physical And Legal Defects And Claims Of Third Parties. 6. The Delivered Subject Of The Order Must Come From The Official Distribution Channel Of The Manufacturer, Which Does Not Exclude Distribution To The European Union Market And Ensures The Implementation Of Warranty Rights. 7. The Offered Subject Of The Order Cannot Be Intended By The Manufacturer To Be Withdrawn From Production Or Sale (End Of Life, End Of Support, End Of Sale) Until The Deadline For Submitting Offers. 8. If The Provisions Of The Specification Are, In The Contractors Opinion, Unclear, Incomplete, Imprecise Or Incorrect, The Contractor Is Obliged To Ask A Question Before Submitting The Offer. 10. The Deadline For Implementing The Agreement Is Up To 6 Months From The Date Of Conclusion Of The Agreement. The Equipment Will Be Delivered After The Ordering Party Places A Delivery Order Specifying The Start And End Date Within Which The Contractor Is Obliged To Complete The Delivery. The Ordering Party Is Obliged To Place A Delivery Order No Later Than 30 Days From The Date Of Conclusion Of The Agreement. The Starting Date Of Delivery Specified In The Delivery Order Cannot Fall Earlier Than September 1, 2026. 11. Pursuant To Art. 257 Of The Act On Public Procurement, The Ordering Party Envisages The Possibility Of Invalidating The Proceedings In Question If The Funds That The Ordering Party Intended To Allocate To Finance All Or Part Of The Order Have Not Been
