5.1. The Subject Of The Order Is A Service In The Field Of Management Of The Municipal Real Estate Resources Of The City Of Giżycko In Accordance With The Detailed Description Of The Subject Of The Order, Constituting Annex 3 To The Swz And In Accordance With The Draft Provisions Of The Contract, Constituting Annexes No. 2 And 2A, Respectively, To The Swz. The Properties And Scopes Covered By This Subject Of The Order Are Indicated In Annex No. 3A To The Swz - List Of Properties To Be Managed.5.2. Cpv (Common Procurement Vocabulary): 70330000-3 – Property Management Services On A Direct Payment Or Contract Basis.5.3. The Ordering Party, Pursuant To Art. 95 Of The Public Procurement Law Requires The Contractor Or Subcontractor To Employ, Under An Employment Relationship, Persons Performing Activities Related To The Execution Of The Contract, The Performance Of Which Consists In Performing Work In The Manner Specified In Art. 22 §1 Of The Act Of June 26, 1974 - Labor Code (Consolidated Text: Journal Of Laws Of 2025, Item 277, As Amended)5.4. The Above Requirement Of Employment On The Basis Of An Employment Relationship Applies To Employees Directly Performing Activities Related To The Performance Of Work Specified In Points I-V Of The Detailed Description Of The Subject Of The Contract Constituting Annex No. 3 To The Swz, Consisting In Performing Work Within The Meaning Of Art. 22 §1 Of The Act Of June 26, 1974 - Labor Code, In Particular: A) Supervision Of The Order Execution, B) Tasks In The Proper Operation Of Buildings, Premises, Areas, C) Tasks In The Field Of Servicing Users Of Municipal Real Estate, D) Tasks In The Field Of Financial And Accounting Services.5.5. The Above Requirement Does Not Apply To Freelancers, Including Designers, Construction Managers And Works Managers. 5.6. By The Date Of Signing The Contract, The Contractor Is Obliged To Submit A List Of These Persons (Appendix No. 4 To The Draft Provisions Of The Contract) Together With A Statement Confirming Their Employment Under An Employment Contract, As Well As, At Each Request Of The Ordering Party, Evidence Indicating Their Employment Under An Employment Contract. After Concluding The Contract, The Contractor Is Also Obliged, At Each Request Of The Ordering Party, To Submit A List Of Persons Along With A Statement Confirming Their Employment Under An Employment Contract And That They Are Not In Arrears With The Payment Of Remuneration As At The Date Of Submitting The Statement. At Each Stage Of The Implementation Of The Subject Of The Contract, The Ordering Party Has The Right To Demand That The Contractor Prove The Fact That People Are Employed Under An Employment Contract.5.7. In Case Of Justified Doubts As To Compliance With Labor Law By The Contractor Or Subcontractor, The Ordering Party May Request An Inspection By The National Labor Inspectorate. 5.8. Detailed Requirements Regarding The Implementation And Enforcement Of The Employment Requirement Based On An Employment
