1. The Scope Of The Subject Matter Of The Contract Includes: - Part I: 1) Operational Works Aimed At Maintaining The Constant Technical Efficiency Of Grates On Water And Drainage Facilities In Szczecin, Specified In Annex No. 6 To Swz, 2) Failures And Other Operational Works Aimed At Maintaining The Constant Technical Efficiency Of Water And Drainage Devices And Grates On Water And Drainage Facilities In Szczecin, Which Are Specified In Annex No. 7 To The Swz And Works That Are Not Specified In Annex 6 To The Swz,2. Facilities Covered By The Subject Of The Order: Part I: Grates On Water And Drainage Devices Specified In Annex No. 5 To The Swz, As Well As: - Watercourses, - Water Reservoirs, - Retention Reservoirs (Including Dry Ones), - Drainage Ditches, - Culverts, - Sand Traps.3. The Contractor Will Be Obliged To Be Ready And To Proceed With The Execution Of The Subject Of The Order In The Event Of A Failure - 24 Hours A Day. In Case Of Failure - Man-Hour Rate For Work Performed From 15.00 To 9.00 P.M. Will Amount To 150% Of The Gross Man-Hour Rate Resulting From The Offered Price, And From 9.00 P.M. To 7.00 Will Be 200% Of The Gross Man-Hour Rate Resulting From The Offered Price, And On Sundays And Holidays - 200% Of The Gross Man-Hour Rate Resulting From The Offered Price.4. The Contractor Will Perform The Subject Of The Order With The Utmost Care Required From An Entity Professionally Providing This Type Of Services, On The Basis Of Ensuring The Highest Quality Of Work, In Accordance With The Provisions Of Generally Applicable Law, Including, Among Others: Act Of December 14, 2012 On Waste (Consolidated Text: Journal Of Laws Of 2023, Item 1587, As Amended) - The Producer Of Waste Generated During The Implementation Of The Subject Of The Order Is The Contractor (Legal Basis: Article 3(1)(32) Of The Waste Act).5. Warranty And Guarantee: 1) The Contractor Will Provide A Warranty And Guarantee For The Completed Coastal Reinforcements For A Period Of 18 Months, Counting From The Date Of Signing The Final Acceptance Report Of These Works, 2) Under The Guarantee And Warranty, The Contractor Is Obliged To Remove Defects At His Own Expense, Within 7 Days From The Date Of Reporting Them In Writing. If The Defects Are Not Removed Within This Period, The Defects Will Be Removed By The Ordering Party On Its Own Or With The Help Of Third Parties, At The Expense And Risk Of The Contractor, Without The Need For Any Additional Requests, 3) The Guarantee And Warranty Period Is Extended By The Time Counted From The Date Of Finding The Defect To The Date Of Its Removal.
