The Subject Of The Order Is The Provision Of Ad Hoc Supervision And Monitoring Services Of Facilities Located In The Agricultural Property Resource Of The State Treasury (Hereinafter Referred To As Zwrsp) At The Disposal Of The National Center For Agricultural Support, Field Branch In Olsztyn (Hereinafter Referred To As Kowr Ot In Olsztyn). The Service Must Be Provided In Accordance With The Act Of August 22, 1997 On The Protection Of Persons And Property (Consolidated Text, Journal Of Laws Of 2025, Item 532) And Relevant Implementing Acts.2. A Detailed Description Of The Subject Of The Order Can Be Found In The Draft Provisions Of The Contract And In The Annexes To The Above-Mentioned. Provisions Constituting Annex No. 6 To The Swz And In The Price Form Constituting Annex No. 2 To The Swz.3. This Is A Service Request With The Basic Dictionary Alphanumeric Code Cpv 79710000-4.4. The Ordering Party Does Not Allow The Possibility Of Submitting Partial Offers. Division Into Parts Would Lead To A Deterioration Of The Effectiveness Of The Proceedings. Awarding The Contract To A Larger Number Of Contractors Would Cause Difficulties For The Ordering Party In The Proper Implementation Of The Services Provided, While Increasing Costs. If There Were Several Contractors, Problems Would Arise With The Organization Of Assigned Tasks And The Flow Of Activities, Which Are Priorities In The Case Of Security. Moreover, Dividing The Order Into Parts Could Threaten The Coherence And Continuity Of Service Provision And Result In Additional Administrative And Organizational Costs Related To The Need To Conclude And Supervise Numerous Contracts And Coordinate Various Activities.5. The Ordering Party In Accordance With Art. 95 Of The Public Procurement Law Requires The Contractor Or Subcontractor To Employ, On The Basis Of An Employment Relationship, Persons Performing The Activities Indicated Below In The Scope Of Contract Execution, The Performance Of Which Consists In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Consolidated Text: Journal Of Laws Of 2025, Item 277, As Amended). Therefore, This Requirement Applies To All Physical Workers Providing Property Protection Services In The Form Of Direct, Ad Hoc Physical Protection At The Ordering Partys Facilities. The Requirement Of Employment Under An Employment Contract Does Not Apply To Subcontractors Running A Business On The Basis Of An Entry In The Ceidg Or Other Equivalent Registers And Performing Personally And Independently The Activities Entrusted To Them In The Scope Of The Implementation Of The Subject Of The Order.
