The Subject Of The Order Is To Equip The Reserve Bay No. 206 At The 220 Kv Switchgear In Se Joachimów For The Connection Of Mee Turów. A Detailed Description Of The Subject Of The Order Can Be Found In Part Ii Of The Swz Functional And Utility Program.3. Each Time, In All Cases In Which The Ordering Party Describes The Subject Of The Order By Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Act, The Ordering Party Allows Solutions Equivalent To Those Described, If They Allow To Obtain Features Or Parameters Not Worse Than Those Mentioned. The Above Means That The Contractor May Use The Solutions Described By The Ordering Party Or Equivalent. 4. Pursuant To Art. 101 Section 5 Of The Act, The Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate That The Supplies, Services Or Construction Works Offered By Him Meet The Requirements Specified By The Ordering Party, Provided That The Contractor Proves In The Offer, In Particular By Means Of Evidence Referred To In Art. 104-107 Of The Act, That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Contract. 5. Pursuant To Art. 18 Section 2 In Connection With Art. 133 Section 3 Of The Act, The Ordering Party Establishes Requirements Regarding The Confidentiality Of Information Provided To Contractors In The Course Of The Procedure. Due To The Above, Part(S) Of The Specifications Of The Contract Terms Will Be Provided Only To Those Contractors Who Submit To The Ordering Party A Declaration Obliging The Contractor To Keep The Information Provided During The Contract Award Procedure Confidential In Accordance With Template No. 6 To Part Iii Of The Swz. 6. The Ordering Party Envisages The Use Of The Supervision Option Right Within The Meaning Of Art. 441 Of The Public Procurement Law.
