Service Concession – Hms Card . Descriptionall Businesses That Carry Out Work On Building And Construction Sites, All Approved Cleaning Businesses, Approved Businesses In Car Care, Wheel Changing And Wheel Storage, As Well As Businesses That Transport Other Peoples Goods By Car (From 1 January 2026) And Other Businesses That May Be Subject To The Regulations In The Future, Both Norwegian And Foreign, Are Required To Equip Their Employees With Hms Cards. The Users Of The Solution Are These Businesses As Well As Other Public And Private Actors With A Factual And Official Need For Access To The Solution (The User/Users). The Ministry Of Labor And Social Affairs Has Given The Employer Responsibility For The Hse Card. The Client Is Basically Responsible For The Operation And Maintenance Of All Work Related To The Hms Card, Including The Establishment, Operation, Maintenance, Further Development Of Necessary Solutions For The Hms Card, As Well As The Design, Production, Personalization And Distribution Of The Hms Card (The Hms Card Scheme) And That The Hms Card Scheme Works As Intended. In Connection With Entering Into This Agreement, The Principal Will Transfer The Responsibility For The Hse Card Scheme That Follows From This Agreement To The Supplier As A Service Concession. This Means That The Suppliers Remuneration Consists Entirely Of The Right To Offer Hms Cards And Associated Services As Defined In The Agreement Against Payment From The Users. It Also Means That The Operating Risk Associated With The Service Has Been Transferred To The Supplier, Including The Risk Associated With The Demand For The Service And (To The Extent That It Is Relevant) The Delivery Risk. Beyond What Is Specifically Stated In The Agreement, The Supplier Cannot Therefore Demand Compensation Or Change The Prices In The Agreement In The Event Of Changes In The Earnings Base Or As A Result Of Other Conditions That Affect The Suppliers Turnover Or Return. In Connection With All Work And All Obligations Relating To The Hse Card Being Transferred To The Supplier, The Supplier Is Also Responsible For Developing The Hse Card In Line With Changes To Current Regulations And Adapting The Delivery To Future-Oriented Solutions To Improve The Hse Card Scheme. The Agreement Means That The Users Must Order An Hse Card From The Supplier. The Supplier, For Its Part, Must, As A Result Of The Agreement, Deal With Both The Client And The Users. One Of The Purposes Of The Agreement Is Therefore To Facilitate Good Cooperation Between The Principal And The Supplier, And Between The Supplier And The Users. Furthermore, The Purpose Of The Agreement Is To Ensure That The Hms Card Scheme Is User-Friendly, Stable And Can Be Adapted In Line With Future Innovative Solutions, And That The Adaptations Will Not Without Further Ado Be At The Expense Of The Users. The Agreement Includes The Establishment, Development And Maintenance Of A Solution For The Hms Card Scheme, As Well As The Delivery Of Services Related To The Production And Distribution Of Hms Cards, Including Operation, Personalisation, Development, Design And Handling Of Register Entries (The Delivery). The Scope, Execution And Further Specification And Prerequisites For The Delivery Are Described In More Detail In The Annexes Included In The Agreement.
