Software Package And Information Systems - Integrated Erp It System For Managing The Hr, Payroll And Financial And Accounting Areas For The Supreme Administrative Court And 16 Provincial Administrative Courts Along With The Warranty Service And Authors Supervision. The Procedure For Awarding The Public Procurement In Question Is Conducted In The Form Of An Open Tender, In Compliance With The Rules Set Out In Chapter 3, Section 2 Of The Act Of September 11, 2019, Public Procurement Law (Journal Of Laws Of 2024, Item 1320, As Amended), Hereinafter Referred To As The Pzp Act In The Content Of The Swz. The Estimated Value Of The Contract Exceeds The Eu Threshold Referred To In Art. 3 Section 1 Point 1 Of The Public Procurement Law. The Documents Required To Confirm That Contractors Meet The Conditions For Participation In The Procedure And Those That Are Required To Demonstrate The Lack Of Grounds For Exclusion Will Be Requested In Accordance With The Authorization Resulting From The Content Of: Regulation Of The Minister Of Development, Labor And Technology Of December 23, 2020 On Subjective Means Of Evidence And Other Documents Or Statements That The Contracting Authority May Request From The Contractor (Journal Of Laws Of 2020, Item 2415, As Amended); In This Procedure, The Ordering Party Will Use The So-Called Reverse Procedure In Accordance With Art. 139 Section 1 Of The Public Procurement Act, As A Result Of Which The Contracting Authority Will First Examine And Evaluate The Offers, And Then Subjectively Qualify The Contractor Whose Offer Was Rated The Highest In Terms Of The Lack Of Grounds For Exclusion And Compliance With The Conditions For Participation In The Procedure. Due To The Use Of The Reverse Procedure, The Contracting Authority, Pursuant To Art. 139 Section 2 Of The Public Procurement Act, Does Not Require Submitting The Single European Procurement Document Jedz/Espd With The Offer. The Ordering Party Will Require The Submission Of The Epd/Espd In Electronic Version Only From The Contractor Whose Offer Was Rated The Highest. If There Are Grounds For Exclusion Against The Contractor Whose Offer Was Rated The Highest, The Contractor Does Not Meet The Conditions For Participation In The Proceedings, Does Not Submit Subjective Evidence Or The Declaration Referred To In Clause Xv Section 2 Confirming The Lack Of Grounds For Exclusion Or The Fulfillment Of The Conditions For Participation In The Procedure, The Contracting Authority Will Re-Examine And Evaluate The Offers Of The Remaining Contractors, And Then Make A Subjective Qualification Of The Contractor Whose Offer Was Rated The Highest In Terms Of The Lack Of Grounds For Exclusion And The Fulfillment Of The Conditions For Participation In The Procedure. The Ordering Party Continues The Procedure Referred To In Section 6 Until The Most Advantageous Offer Is Selected Or The Contract Award Procedure Is Canceled. The Ordering Party Does Not Provide For Reimbursement Of The Costs Of Participation In The Proceedings To The Contractors. The Order Is Intended To Be Financed From National Funds (The Ordering Partys Own Funds). The Ordering Party Pursuant To Art. 257 Of The Public Procurement Act, May Invalidate The Contract Award Procedure If The Public Funds That The Contracting Authority Intended To Use To Finance All Or Part Of The Contract Are Not Awarded To It.
