1. The Subject Of The Order Is Comprehensive Banking Services For The Budget Of The Ziębice Commune And Its Organizational Units In The Period From January 1, 2026 To December 31, 2029.2. The Scope Of The Subject Of The Order Is Specified In Annex No. 7 To The Swz - Detailed Description Of The Subject Of The Order.3. Information About The Contractors Obligation To Personally Perform Key Tasks, If The Ordering Party Makes Such A Reservation: The Ordering Party Reserves A Key Part Of The Order. The Key Part Of The Order Should Be Understood As The Banking Activities Listed In Art. 5 Of The Act Of August 29, 1997, Banking Law (Journal Of Laws Of 2024, Item 1646, As Amended).4. Any Indication In The Procurement Documents Constituting The Description Of The Subject Of The Procurement Of Proper Names, Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes The Products Or Services - Is Not Intended To Violate Art. 16 Pzp. And Art. 99 Section 4 Pzp, But In Particular Serves To Implement Art. 17 Section 1 Point 1 And 2 Of The Public Procurement Law. The Descriptions Included In The Swz Are Intended To Specify The Quality, Technological, Performance And Functional Expectations Of The Ordering Party. Pursuant To Art. 99 Section 5 And Section 6 And Art. 101 Section 4 Pzp. The Ordering Party Indicates That The Contractor May Offer The Subject Of The Order With A Specific Description Contained In The Procurement Documents Or An Equivalent Description. The Ordering Party Allows Equivalent Solutions Provided That They Meet The Same Technological, Performance And Functional Level Assumed In The Order Documents. For This Purpose, If The Description Of The Subject Of The Contract Includes Proper Names, The Contracting Authority Attaches The Criteria Used To Assess Equivalence. In Each Case When The Contracting Authority Has Described The Subject Of The Contract By Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, It Allows Equivalent Solutions. The Ordering Party Declares That It Allows The Submission Of Offers In Which Individual Devices Or Materials Listed In The Order Documents May Be Replaced With Equivalent Devices Or Materials. The Concept Of Equivalent Materials And Devices Should Be Understood As Materials That Guarantee The Provision Of Services In Accordance With The Order Documents And Ensure That Technical Parameters Are Not Worse Than Those Assumed. Equivalent Products And Devices Must Be Authorized For Trading And Use In Accordance With Applicable Law. The Contractor Who Offers Equivalent Products And Devices Requiring A Change In Its Decisions Will Have To, As Part Of The Execution Of The Order On Behalf Of The Ordering Party, Obtain The Required Decisions Using Its Own Efforts And At Its Own Expense, While Guaranteeing The Execution Of The Order Within The Time Specified In The Tor.
