The Subject Of The Order Is The Implementation Of An Investment Task Titled: Modernization Of The Nysa Mouth Water Barrage, Implemented As Part Of The Projects (Projects) Entitled: Modernization Of The Damming Structure At The Nysa Mouth Water Barrage At Km 180.50 Of The Oder River, Together With Accompanying Infrastructure And Modernization Of The Lock And Control Room At The Nysa Mouth Water Barrage, Together With The Reconstruction Of Outer Ports And Accompanying Facilities, Co-Financed From Eu Funds In Under The European Funds Program For Infrastructure, Climate, Environment 2021-2027, Priority Fenx.05 Support For The Transport Sector From The Erdf, Measure Fenx.05.07 Maritime Security And Inland Waterways Outside Ten-T. The Subject Of The Order Includes The Modernization Of The Nysa Mouth Water Barrage, I.E. The Damming Structure With Accompanying Infrastructure, The Lock And The Control Room, Along With The Reconstruction Of Outer Ports And Accompanying Facilities. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 1 To The Swz. Equivalent Solutions. If The Description Of The Subject Of The Contract Or Other Procedural Documents Used To Describe The Subject Of The Contract For The Performance Of Construction Works Contain Any Trademarks, Patents Or Origin, Sources Or Specific Processes That Characterize Products Or Services Provided By A Specific Contractor, The Ordering Party Allows Equivalent Solutions (Or Equivalent - In Accordance With Article 101(4) Of The Public Procurement Law). They Concern All Elements/Components Of The Description Of The Subject Of The Contract In These Proceedings That Are Required From The Contractor. The Principles For Assessing Equivalent Solutions Applicable In This Procedure Cover The Scope Of Examination And Evaluation Of Offers, Where Failure To Complete All Elements Of This Description May Be The Basis For Rejection Of The Offer Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Law. The Rules For Assessing An Equivalent Solution Will Also Apply During The Implementation Of The Agreement, Where In The Event Of The Intention To Introduce An Equivalent Solution Provided For In The Provisions Of This Tor And The Description Of The Subject Of The Contract During Its Implementation, They Will Determine, Among Other Things, Whether The Ordering Party May Allow An Equivalent Solution Or Not (Article 454 Of The Public Procurement Law). A Similar Rule Applies In Cases Where The Description Of The Subject Of The Contract Includes References To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law. Offering Solutions Equivalent To Those Indicated In The Description Of The Subject Of The Order Requires Additional Proof That The Offered Solution Is Equivalent With Technical, Operational And Utility Parameters Not Worse Than Those Required By The Ordering Party. The Burden Of Demonstrating Compliance With These Requirements Lies With The Contractor In The Submitted Offer Or, If This Case Occurs During The Implementation Of The Agreement - When The Need To Make Such A Change Arises. The Contractor Who Refers To Equivalent Solutions Described According To The Principles Indicated Above
