Contract Award For Services In The Field Of Health Care Are Different (Reimbursement Of Costs Of The Business Entity Related To The Free And Subsidized Supply Of Medicines In Accordance With The Resolution Of The Cabinet Of Ministers Of Ukraine No. 1303 Of 17.08.1998 On Regulating The Free And Subsidized Supply Of Medicines According To Doctors Prescriptions In The Case Of Outpatient Treatment Of Certain Population Groups And By Certain Categories Of Diseases). Procurement Is Not Subject To The Law Of Ukraine On Public Procurement, Since According To Paragraph 25 Of The First Part Of Article 1 Of The Law, Public Procurement (Hereinafter - Procurement) Is The Purchase Of Goods, Works And Services By The Customer In Accordance With The Procedure Established By The Law. At The Same Time, In Accordance With Paragraph 6 Of The First Part Of Article 1 Of The Law, A Procurement Contract Is An Economic Contract Concluded Between The Customer And The Participant As A Result Of The Procurement/Simplified Procurement Procedure And Provides For Paid Provision Of Services, Performance Of Works Or Purchase Of Goods. Thus, In The Event That The Expenses Are Incurred By The Customer Precisely As Reimbursement (Compensation) Of Expenses And Do Not Provide For The Conclusion Of A Purchase Contract, The Provisions Of The Law, As Well As The Subordinate Legal Acts Developed For Its Implementation, Such Expenses Do Not Apply. Services In The Field Of Health Care Various (Reimbursement Of Costs Of The Economic Entity Related To The Free And Subsidized Supply Of Medicinal Products In Accordance With The Resolution Of The Cabinet Of Ministers Of Ukraine No. 1303 Of 17.08.1998 On Regulating The Free And Subsidized Supply Of Medicinal Products According To Doctors Prescriptions In The Case Of Outpatient Treatment Of Certain Groups Of The Population And Under Certain Categories Of Diseases). Procurement Is Not Subject To The Law Of Ukraine On Public Procurement, Since According To Clause 25 Of The First Part Of Article 1 Of The Law, Public Procurement (Hereinafter - Procurement) Is The Purchase By The Customer Of Goods, Works And Services In Accordance With The Procedure Established By The Law.
