Contract Award For Thermal Energy (Procurement Is Carried Out Taking Into Account The Paragraph Of The Fourth Sub-Clause 5 Of Clause 13 Of The Peculiarities Of Public Procurement Of Goods, Works And Services For Customers Provided For By The Law Of Ukraine On Public Procurement For The Period Of The Legal Regime Of Martial Law In Ukraine And Within 90 Days From The Date Of Its Termination Or Cancellation, Approved By The Resolution Of The Cabinet Of Ministers Of Ukraine Dated October 12, 2022 No. 1178, Namely: Lack Of Competition For Technical Reasons, Which Must Be Documented By The Customer (Documentary Confirmation Of The Absence Of Competition For Technical Reasons: In Accordance With The Provisions Of The Fourth Subparagraph Of Paragraph 5 Item 13 Of The Peculiarities Of Public Procurement Of Goods, Works And Services For Customers Provided For By The Law Of Ukraine On Public Procurement For The Period Of Validity Of The Legal Regime Of Martial Law In Ukraine And Within 90 Days From The Date Of Its Termination Or Cancellation, Approved By The Resolution Of The Cabinet Of Ministers Of Ukraine Dated 12 October 2022 R. No. 1178, Purchase By Customers Of Goods And Services (Except Current Repair Services), The Cost Of Which Is Or Exceeds Uah 100,000, Current Repair Services, The Cost Of Which Is Or Exceeds Uah 200,000, Works, The Cost Of Which Is Or Exceeds 1.5 Million Hryvnias, Can Be Carried Out By Concluding A Purchase Contract Without The Use Of Open Tenders And/Or An Electronic Catalog For The Purchase Of Goods In The Event That: Works, Goods Or Services Can Be Performed, Delivered Or Provided Exclusively By A Certain Business Entity In One From The Following Cases: In Particular, The Absence Of Competition For Technical Reasons, Which Must Be Documented By The Customer. According To Para. 2 H. 1 St. 1 Of The Law Of Ukraine On Natural Monopolies A Natural Monopoly Is A State Of The Product Market In Which The Satisfaction Of Demand On This Market Is More Effective In The Absence Of Competition Due To The Technological Features Of Production (In Connection With A Significant Decrease In Production Costs Per Unit Of Goods As Production Volumes Increase) , And The Goods (Services) Produced By Subjects Of Natural Monopolies Cannot Be Replaced In Consumption By Other Goods (Services), Therefore The Demand In This Product Market Is Less Dependent On Price Changes For These Goods (Services) Than The Demand For Other Goods (Services).
