1. The Subject Of The Order Is A Comprehensive Supply Of Gas Fuel To The Warsaw Crisis Intervention Center In Warsaw. 2. A Detailed Description Of The Subject Of The Order Is Presented In Annex No. 1 To The Swz Entitled Description Of The Subject Of The Order. 3. The Supply Of Gas Fuel Is To Take Place On The Basis Of A Contract Containing The Provisions Of The Sales Contract And The Contract For The Provision Of Gas Distribution Services (Comprehensive Contract) And Be Performed Under The Conditions Specified In The Provisions Of The Act Of April 10, 1997, Energy Law (Consolidated Text: Journal Of Laws Of 2022, Item 1385, As Amended), The Civil Code, The Implementing Regulations Issued On Their Basis And In Accordance With The Draft Provisions Of The Contract Constituting Annex No. 5 To The Swz. 4. The Contractor Must Have A Current Contract With The Distribution System Operator (Dso), I.E. Polska Spółka Gazownictwa Sp. Z O. O., For The Warsaw Area, Enabling Comprehensive Delivery Of Gas Fuel Via The Osd Distribution Network To The Gas Consumption Point Specified In The Description Of The Subject Of The Order Constituting Annex No. 1 To Swz.5. The Contractor Will Be Obliged To Ensure The Quality Standards Of The Ordering Partys Service In Accordance With The Applicable Energy Law Provisions. It Should Ensure Continuity Of Supplies Without Any Interruptions In Supplies And Have A Reserve Guaranteeing Continuity Of Supplies.6. The Ordering Party Declares That The Forecast Consumption Of Natural Gas Is Estimated For A Period Of 36 Months. Estimated Gas Consumption Levels Are Based On Actual Historical Gas Consumption From Previous Years.7. The Forecast Is Used Only To Compare Offers And Does Not Constitute An Obligation On The Part Of The Ordering Party To Purchase Gas In The Given Quantity. The Estimated Amount Of Gas Is For Calculation Purposes Only. The Contractor Will Not Be Entitled To Any Claim For Failure To Collect The Expected Amount Of Gas Fuel By The Ordering Party. The Actual Amount Of Gas Purchased During The Execution Of The Contract Will Result From The Current Needs Of The Ordering Party, But Will Be No Less Than 80% And No More Than 120% Of The Demand Specified In Annex 1 To The Swz.
