The Subject Of The Order Is The Preparation And Delivery Of Meals For The Primary School. The Size Of The Subject Of The Order Is: A) Lunches For Students Of Grades I-Viii And Employees - 13,160 Meals. The Size Of The Subject Of The Order Is Estimated, And The Ordering Party Reserves The Right To Reduce By A Maximum Of 50% Or Increase By A Maximum Of 50% The Size Of The Subject Of The Order, Including Individual Meals, And This Right Cannot Constitute The Basis For Directing The Ordering Partys Claims, Including Financial Claims From The Contractor. A Detailed Description Of The Subject Of The Order Is Attached As Annex No. 7 To The Swz. All Requirements Specified In The Swz Are Minimum Requirements And Their Fulfillment Is Obligatory. Failure To Meet The Minimum Requirements Will Result In Rejection Of The Offer Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Law As Inconsistent With The Terms Of The Order. If The Swz Contains Trademarks, Patents Or Origins, Sources Or A Specific Process That Characterizes Products Or Services Provided By A Specific Contractor, The Ordering Party Allows The Offer Of Equivalent Solutions With Parameters Not Worse Than Those Indicated By The Ordering Party. A Contractor Who Relies On Equivalent Solutions Is Obliged To Demonstrate That The Construction Works He Offers Meet The Requirements Specified By The Ordering Party. Equivalent Solutions Used By The Contractor Must Be At Least:• Of The Same Strength And Durability, With The Same Level Of Aesthetics;• Of Technical Parameters Indicated In The Description Of The Subject Of The Order;• Meet The Same Functions, Safety And Quality Requirements;• Have Appropriate Documents Authorizing Use. If The Swz Includes A Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 Of The Public Procurement Law And Art. 101 Section 3 And 5 Of The Pzp, The Ordering Party Allows Equivalent Solutions. The Ordering Party Emphasizes That Any Indications Of Products Or Services From Specific Manufacturers Specify The Minimum Quality Parameters And Functional Features That The Products Or Services Must Meet In Order To Meet The Requirements Set By The Ordering Party And Constitute Only A Quality Standard Of The Subject Of The Order And Are Not Intended To Privilege Or Eliminate Certain Contractors Or Products. A Contractor Who Refers To Equivalent Solutions Is Obliged To Prove That The Solution He Offers Meets The Requirements Specified In The Description Of The Subject Of The Order. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Their Description Or Standards.
