Motion Picture And Video Production Services – Production And Broadcasting Of An Advertising Spot As Part Of The Ecomarinas Project. 1. The Subject Of The Order Is The Production Of An Advertising Spot For The Ecomarinas Project In Two Versions: 1) 30-Second Version - Intended, Among Others, For Broadcast In Social Media And On Websites, 2) 15 - Second - Intended, Among Others, For Broadcast On Television And In Cinemas. And Broadcasting The Spot On: 1) National And Regional Television Channels. 2) Cinemas Located In The Pomeranian And Warmian-Masurian Voivodeships, 3) Online Social And Video Platforms. 2. A Detailed Description Of The Subject Of The Order Is Specified In The Detailed Description Of The Subject Of The Order (Sopz), Constituting Annex No. 2 To The Swz And In The Contract Template, Which Constitutes Annex No. 3 To The Swz. 3. In All Provisions Of The Swz And Its Annexes In Which The Ordering Party Refers To Or Describes The Subject Of The Order By: 1) Indicating Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor (In Accordance With Article 99(5) Of The Public Procurement Act), Equivalent Solutions Are Allowed For All These Cases. In A Situation Where The Ordering Party Has Specified The Permissible Scope Of Equivalence In The Content Of The Swz, The Contractor, Using Equivalent Solutions, Within The Limits Allowed By The Ordering Party In The Swz, Must Specify The Scope Of The Equivalent Solution Used. If The Description Of The Subject Of The Order Includes The Names Of Materials, Products Or Devices From Specific Manufacturers, They Should Be Treated Only As A Definition Of The Desired Standard And Quality. 2) Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, The Ordering Party, In Accordance With Art. 101 Section 4 Of The Public Procurement Law Allows Solutions Equivalent To Those Described. Equivalence Should Be Understood As Offering A Product That Provides The Same Or Higher Level In Terms Of Operational, Technical, Quality, Functional Parameters And Normative Requirements As In The Case Of References Resulting From The Tor And Annexes. If An Equivalent Solution Is Offered, The Contractor Is Obliged To Demonstrate The Equivalence Of The Solutions Used. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Its Description Or Standards. 4. The Ordering Party Does Not Reserve The Right To Apply For The Order Only By Contractors Referred To In Art. 94 Of The Public Procurement Law. 5. Subcontracting: 1) The Contractor May Entrust The Performance Of Part Of The Order To A Subcontractor(S); 2) In Connection With The Execution Of The Order, The Ordering Party Does Not Reserve The Obligation To Personally Perform Key Tasks Of The Order; 3) The Ordering Party Requires That In The Event Of Entrusting Part Of The Order To Subcontractors, The Contractor Should Indicate In The Offer The Parts Of The Order Whose Performance It Intends To Entrust To Subcontractors And Provide (If They Are Already Known) The Names Of These Subcontractors Along With The Subject Of The Subcontracts For Which They Are Proposed; 4) Entrusting Parts To Subcontractors Does Not Release W
