The Contractor May Receive Additional Points If He Indicates A Response Time Shorter Than Required In The Tender Form. Required Response Time For Parts 1 And 2 (From The Date Of Notification, E.G. By Fax, E-Mail Or Telephone) – 3 Days.3. In Order To Ensure Adequate Protection Of The Contractors And The Employers Employees Before, During And After The Completion Of The Works, The Contractor Is Obliged To Apply The Following Safety Measures At His Own Expense: 1) All Works Should Be Carried Out In Accordance With The Regulations, Applicable Standards, Technical Conditions And Construction Practice, Occupational Health And Safety And Fire Protection Regulations, Regulations And Guidelines Relating To The Prevention Of The Sars-Cov-2 Virus Pandemic Or The Disease Caused By This Virus (Covid-19) And In Accordance With The Ordering Partys Recommendations, 2) The Works Should Be Carried Out In Accordance With The Requirements Specified In The Procedure Documentation, 3 ) The Materials And Devices Used Should Be Of The Highest Quality And Dimensions, Have Appropriate Approvals For Use In Construction And Ensure Operational Efficiency.4. The Contractor Will Be Responsible For The Entire Process, Including The Course And Timely Execution Of The Order, Quality, Compliance With The Technical And Quality Conditions Specified For The Subject Of The Order. Due Diligence Is Required When Executing The Order, Understood As The Diligence Of A Professional In The Activities Covered By The Subject Of This Order.5. Equivalent Solutions: 1) If The Description Of The Subject Of The Order Contains Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, The Ordering Party Shall Indicate The Criteria Used To Assess Equivalence In The Description Of The Subject Of The Order. 2) If The Description Of The Subject Of The Order Refers To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Article 101, Section 1, Point 2 And Section 3 Of The Public Procurement Law, The Ordering Party Allows Solutions Equivalent To Those Described.3 ) The Contractor Is Obliged To Prove In The Offer, In Particular By Means Of Evidence Referred To In Articles 104-106 Of The Public Procurement Law, That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Order.4) If The Description Of The Subject The Order Refers To The Performance Or Functionality Requirements Referred To In Article 101(1)(1) Of The Public Procurement Law, The Contractor Is Obliged To Prove In The Offer, In Particular By Means Of Evidence Referred To In Articles 104-106 Of The Act Pzp That The Construction, Supply Or Service Meets The Performance Or Functionality Requirements Specified By The Ordering Party. 6. Employment Requirements Based On The Employment Relationship: Ordering Party Pursuant To Art. 95 Of The Public Procurement Act Requires The Contractor And Subcontractor To Employ, On The Basis Of An Employment Relationship, Persons Performing Activities Related To The Execution Of The Order Indicated By The Ordering Party, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2023, Item 1465, As Amended).1) The Ordering Party Requires That, When Performing The Order, The Contractor Employs Under An Employment Contract Within The Meaning Of The Provisions Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2022, Item 1465, As Amended) Persons Who Will Perform Activities Related To Construction Works Listed In The Swz Throughout The Period Of Performing These Activities.2) The Contractor Is Obliged To Is To Document The Employment Of The Persons Referred To In Point 1. During The Execution Of The Order, At Each Request Of The Ordering Party And Within The Time Specified By The Ordering Party In The Request, The Contractor Will Submit To The Ordering Party: A) A Declaration Of The Contractor Or Subcontractor On The Employment Under An Employment Contract Of Persons Performing The Activities Referred To In Point 1. Referred To In Point 1 Above. This Declaration Should Include In Particular: Precise Identification Of The Entity Submitting The Declaration, Date Of Submission Of The Declaration, Indication That The Activities Covered By The Request Are Performed By Persons Employed Under An Employment Contract, Indicating The Name And Surname Of The Employed Employee, The Date Of Concluding The Employment Contract, The Type Of Employment Contract, Scope Of The Employees Duties And The Signature Of The Person Authorized To Submit A Declaration On Behalf Of The Contractor Or Subcontractor, Or B) Copies Of Employment Contracts Certified By The Contractor Or Subcontractor, Respectively, Of Persons Performing The Activities Referred To Above During The Execution Of The Order. Declaration Of The Contractor Or Subcontractor. Copies Of Contracts Should Contain Information, Including Personal Data, Necessary To Verify Employment Under An Employment Contract, In Particular The Name And Surname Of The Employed Employee, The Date Of Conclusion Of The Employment Contract, The Type Of Employment Contract And The Scope Of The Employees Responsibilities, Or C) A Statement Of The Employed Employee Containing Name And Surname Of The Employed Employee, Date Of Conclusion Of The Employment Contract, Type Of Employment Contract, Scope Of The Employees Duties And The Employees Signature.3) Due To The Failure By The Contractor Or Subcontractor To Employ Persons Performing The Activities Indicated In Point 1 Under The Employment Contract, The Ordering Party Provides A Sanction In The Form Of The Contractors Obligation To Pay A Contractual Penalty In The Amount Specified In The Public Procurement Contract Template.
