Materials From The Demolition Of The Surface, I.E. Road Slabs And Aggregate, Road Surface Intended For Removal, Or Reclaimed Asphalt, Owned By The Ordering Party, Should Be Stored In A Place Indicated By The Ordering Party.5. The Bill Of Quantities Is Only An Auxiliary Material For The Quotation Of The Subject Of The Order And, Therefore, The Lump Sum Remuneration For The Execution Of The Work Constituting The Subject Of The Order. In Connection With The Above, The Ordering Party Suggests That The Contractors Carry Out A Local Inspection Of The Area On Their Own And At Their Own Expense And Recommends That They Carefully Read All The Conditions For The Implementation Of The Task In Order To: - Identify All Conditions For The Implementation Of The Subject Of The Order, - Submit A Correct And Realistic Offer Guaranteeing, In The Event Of Choice By The Ordering Party, Execution Of The Subject Of The Order In Accordance With The Documentation, Assuming All Risks And Liability For The Implementation Of All Activities Covered By The Order To The Extent That An Experienced Contractor Can And Should Predict. Resignation From The Above Is The Choice And Risk Of The Contractor If He Incorrectly Assesses The Detailed Scope Of The Subject Of The Order And Its Value.6. The Contractor Is Obliged To Complete The Full Scope Of The Order With Due Diligence, In Accordance With The Terms Of The Procedure Described In The Swz (With Annexes), Applicable Law, Including Those Specified In The Act Of July 7, 1994. Construction Law (Consolidated Text: Journal Of Laws Of 2023, Item 682, As Amended), In Accordance With The Principles Of Construction Practice, Generally Accepted Knowledge In This Area, The Contractors Offer And The Arrangements With The Ordering Party.7. The Contractor Will Provide Surveying Services For The Investment, Including, Among Others, Marking Out The Renovated Section In The Field, Ongoing Surveying Services During The Works, As Well As Preparing An As-Built Inventory.8. Pursuant To Art. 95 Of The Public Procurement Law, The Ordering Party Requires The Contractor Or Subcontractor To Employ, Under An Employment Contract, Manual Workers Directly Performing Construction Works And Other Activities Necessary To Perform The Order (General Construction, Demolition, Earthworks, Cleaning Works).9. Subcontracting: 1) The Contractor May Entrust The Performance Of Part Of The Order To A Subcontractor. The Ordering Party Does Not Reserve The Obligation For The Contractor To Personally Perform Key Parts Of The Order. 2) The Ordering Party Requests That The Contractor Indicate The Part Of The Order The Performance Of Which He Intends To Entrust To A Subcontractor And Provide The Names Of Any Subcontractors, If They Are Already Known - Offer Form, Annex No. 9 To Swz.3) If The Contractor Does Not Indicate In The Offer The Part That He Intends To Entrust Subcontractors, The Ordering Party Will Assume That The Contractor Will Complete The Order Independently.4) Entrusting The Execution Of Part Of The Order To Subcontractors Does Not Release The Contractor From Responsibility For The Proper Performance Of This Order.5) In The Event Of Obtaining An Order And Carrying Out Works With The Participation Of Subcontractors, The Contractor Will Be Obliged To Conclude Contracts With Subcontractors , In Accordance With The Provisions Of Art. 463 And 464 Of The Public Procurement Law And With The Provisions Contained In The Draft Contract Constituting Annex No. 16 To Swz.10. If Anywhere In The Documentation Referred To In Section 3, The Origin (Brand, Trademark, Manufacturer, Supplier) Of The Materials Or Standards Referred To In Art. 99 Section 4 Of The Public Procurement Law, The Ordering Party Allows The Offer Of Materials Or Solutions Equivalent To Those Described, Guaranteeing The Achievement Of Parameters Not Worse Than Those Assumed In The Description Of The Subject Of The Order. The Proper Names Provided In The Description Of The Subject Of The Order Are Not Intended To Violate Art. 16 And 99 Sections 4 Of The Public Procurement Law, And Are Only Intended To Specify The Quality, Technical And Technological Expectations Of The Ordering Party. In The Case Of Materials Whose Trademarks Are Given In The Description Of The Subject Of The Order By Equivalence, The Ordering Party Understands The Use Of Such Materials Whose Technical, Qualitative And Technological Parameters Will Not Be Inferior To The Materials Used In The Solutions And Will Be Accepted By The Ordering Party, It Is Assumed That All Materials And Devices Specified In The Design Documentation From Specific Manufacturers, Specify The Minimum Technical, Quality And Operational Parameters That The Materials/Devices Offered Must Meet In Order To Meet The Requirements Set By The Ordering Party, And The Energy Consumption Of Individual Equivalent Devices Offered Cannot Be Higher Than Assumed In The Design Documentation. The Burden Of Proving That The Material Or Device Is Equivalent To The Requirement Specified By The Ordering Party Rests With The Contractor. The Contractor Is Obliged To Demonstrate That The Given Material/Device Proposed As Equivalent Is Not A Prototype, I.E. It Has Been Tested In Operation In Applications Of A Similar Nature And In Conditions At Least As In The Planned Works, And Works On Other Completed Facilities. The Ordering Party Reserves The Right To Verify Documents Confirming Equivalence, Including A Visit To The Facility Where They Are Used.11. Requirements And Conditions Of Execution: 1) Execution Of The Entire Scope Of The Order Using Own Resources Or The Resources Of Own And Subcontractors, 2) Conclusion Of Contracts With Subcontractors, In Accordance With The Provisions Of Art. 437 Of The Public Procurement Law And In Accordance With The Provisions Contained In The Contract Template - In The Event Of Entrusting Part Of The Order To Subcontractors, 3) During The Construction Period, The Contractor Will Be Obliged To Ensure On The Construction Site, Within The Limits Provided By The Ordering Party, Proper Order, Compliance With Health And Safety Regulations, And Protection Of Persons Located On The Premises. Facilities And Networks As Well As Land Infrastructure Devices And Maintain Them In Good Technical Condition, And Tidy Up The Area After Construction Is Completed,
